Amends the Illinois Vehicle Code. Provides that when a person reports to the Secretary of State that a licensed driver or person holding a permit or applying for a license or renewal is incompetent or otherwise not qualified to hold a permit, the Secretary shall advise the reporting person that unless he or she is a family member of the affected driver, the reporting person's identity shall be provided to the affected driver upon request. Provides that at the request of a driver required to submit to a re-examination, the Secretary shall, if applicable, provide the name of the person who reported the driver to the Secretary. Provides that if the driver was reported by a family member, the Secretary shall inform the driver that the report was made by an unnamed family member. Effective immediately.

| 2 | | Be it enacted by the People of the State of Illinois,
| 3 | | represented in the General Assembly:
| 4 | | Section 5. The Illinois Vehicle Code is amended by changing | 5 | | Section 6-207 as follows:
| 6 | | (625 ILCS 5/6-207) (from Ch. 95 1/2, par. 6-207)
| 7 | | Sec. 6-207. Secretary of State may require reexamination or | 8 | | reissuance of a
license. | 9 | | (a) The Secretary of State, having good cause to believe | 10 | | that a licensed
driver or person holding a permit or applying | 11 | | for a license or license
renewal is incompetent or otherwise | 12 | | not qualified to hold a license or
permit, may upon written | 13 | | notice of at least 5 days to the person require the
person to | 14 | | submit to an examination as prescribed by the Secretary.
| 15 | | Refusal or neglect of the person to submit an alcohol, | 16 | | drug, or
intoxicating compound evaluation or
submit to or | 17 | | failure to successfully complete the examination is
grounds for | 18 | | suspension of the person's license or permit under
Section | 19 | | 6-206 of this Act or cancellation of his license or permit | 20 | | under
Section 6-201 of this Act.

| 1 | | hold a permit, the Secretary shall advise the reporting person | 2 | | that unless he or she is a family member of the affected | 3 | | driver, the reporting person's identity shall be provided to | 4 | | the affected driver upon request. For purposes of this | 5 | | subsection (a), "family member" has the same definition as | 6 | | provided in subsection (6) of Section 103 of the Illinois | 7 | | Domestic Violence Act of 1986. | 8 | | At the request of a driver required to submit to an | 9 | | examination pursuant to this subsection (a), the Secretary | 10 | | shall, if applicable, provide the name of the person or persons | 11 | | who reported the driver to the Secretary. If the driver was | 12 | | reported by a family member, the Secretary shall inform the | 13 | | driver that the report was made by an unnamed family member. | 14 | | (b) The Secretary of State, having issued a driver's | 15 | | license or
permit in error, may upon written notice of at least | 16 | | 5 days to the person,
require the person to appear at a Driver | 17 | | Services facility to have the
license or permit error corrected | 18 | | and a new license or permit issued.
| 19 | | Refusal or neglect of the person to appear is grounds for | 20 | | cancellation of
the person's license or permit under Section | 21 | | 6-201 of this Act.
| 22 | | (c) The Secretary of State, having issued a driver's | 23 | | license or permit to a person who subsequently becomes | 24 | | ineligible to retain that license or permit as currently | 25 | | issued, may, upon written notice of at least 5 days to the | 26 | | person, require the person to appear at a Driver Services |

| 1 | | facility to have the license or permit corrected and a new | 2 | | license or permit issued.
| 3 | | (d) The Secretary of State, having good cause to believe | 4 | | that a driver's license or permit was issued based on invalid, | 5 | | fictitious, or fraudulent documents, may upon written notice of | 6 | | at least 5 days require the person to appear at a Driver | 7 | | Services facility to present valid documents for verification | 8 | | of identity. Refusal or neglect of the person to appear shall | 9 | | result in cancellation of the person's license or permit. | 10 | | (Source: P.A. 97-229, eff. 7-28-11.)
