| 2 | | WHEREAS, The members of the Illinois House of | 3 | | Representatives are saddened to
learn of the death of former | 4 | | Appellate Justice and State Representative
Tobias G. "Toby" | 5 | | Barry, who passed away on April 4, 2017; and
| 6 | | WHEREAS, Justice Barry was born in Chicago to Tobias and | 7 | | Mary
Barry on April 12, 1924; and | 8 | | WHEREAS, Justice Barry served from 1943 to 1946 in the | 9 | | United States Navy as
a combat medic in the Pacific Theater | 10 | | during World War II, where he took part
in the invasions of Iwo | 11 | | Jima and Okinawa before returning to Marquette
University to | 12 | | complete his undergraduate degree; and | 13 | | WHEREAS, Justice Barry earned his Juris Doctorate from the | 14 | | University of
Notre Dame in 1952 and started his life-long | 15 | | legal career; and | 16 | | WHEREAS, After the unfortunate and untimely death of his | 17 | | father, State
Representative Tobias Barry Sr., in 1958, Justice | 18 | | Barry ran as an
independent for his father's seat when | 19 | | Democrats did not select him to fill
the seat; and | 20 | | WHEREAS, While Justice Barry was not elected in 1958, he |

| 1 | | ran for the seat two
years later and was elected as a Democrat; | 2 | | and | 3 | | WHEREAS, Justice Barry continued to serve as a State | 4 | | Representative for 14
years, where he worked tirelessly through | 5 | | several administrations with
Representative E.J. "Zeke" Giorgi | 6 | | for the creation of Interstate 39 as an
alternative to U.S. | 7 | | Route 51; and | 8 | | WHEREAS, Justice Barry finally resigned his seat in the | 9 | | legislature in
December of 1974 to assume the position of an | 10 | | Appellate Judge in the Third
Judicial District to which he had | 11 | | been elected; and | 12 | | WHEREAS, Justice Barry won retention to the bench in 1984, | 13 | | and then in 1990, he
narrowly lost by less than 3,000 votes for | 14 | | a
seat on the Supreme Court; and | 15 | | WHEREAS, Justice Barry decided to retire from the bench in | 16 | | 1994 to resume
private practice with the law firm of Aplington, | 17 | | Kaufman, McClintock, Steele,
and Barry, Ltd., in LaSalle; and
| 18 | | WHEREAS, Governor George Ryan named Justice Barry to serve | 19 | | on the Illinois
Gaming Board in November of 2001; and
| 20 | | WHEREAS, The Supreme Court asked Justice Barry to return to |

District Appellate Court to fill a vacancy on the | 2 | | bench in November of 2002 for
two years; and
| 3 | | WHEREAS, In appreciation for his many contributions to the | 4 | | State of Illinois,
the 94th General Assembly designated the | 5 | | portion of Interstate 39 from
LaSalle-Peru to the Zeke Giorgi | 6 | | Highway as the Tobias "Toby" Barry Highway; and
| 7 | | WHEREAS, Justice Barry is survived by his loving wife, Jan; | 8 | | his daughter,
Michele; his sons, Mark, Patrick, and Daniel; | 9 | | seven grandchildren; and
innumerable friends; therefore, be it
| 10 | | RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE ONE | 11 | | HUNDREDTH GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, that we, | 12 | | along with his family and friends, mourn the passing of former | 13 | | Appellate Justice and State Representative Tobias "Toby" G. | 14 | | Barry; and be it further
| 15 | | RESOLVED, That a suitable copy of this resolution be | 16 | | presented to the family
of Justice Barry as an expression of | 17 | | our respect and deepest sympathy.
