| 1 | | AN ACT concerning health.
| 2 | | Be it enacted by the People of the State of Illinois,
| 3 | | represented in the General Assembly:
| 4 | | Section 5. The Medical Patient Rights Act is amended by | 5 | | adding Section 8 as follows: | 6 | | (410 ILCS 50/8 new) | 7 | | Sec. 8. Equity in health care during public health | 8 | | emergencies. | 9 | | (a) In this Section, "health professional" means a | 10 | | physician, physician assistant, nurse practitioner, a | 11 | | registered professional nurse, advanced practice registered | 12 | | nurse, emergency medical technician, or other individual | 13 | | appropriately licensed or registered to provide health care | 14 | | services. | 15 | | (b) During the pendency of a proclamation issued by the | 16 | | Governor under the Illinois Emergency Management Agency Act | 17 | | declaring that a public health-related emergency exists, a | 18 | | health professional: | 19 | | (1) shall permit people eligible for critical or | 20 | | intensive care services to remain eligible regardless of a | 21 | | patient's age or disability; | 22 | | (2) shall provide individual patient assessments based | 23 | | on the best available objective medical evidence; |

| 1 | | (3) shall not deny a patient's care based on | 2 | | stereotypes, assessments of a patient's quality of life, | 3 | | or assessments related to disability or other identity | 4 | | factor; and | 5 | | (4) shall not make decisions on health care resources | 6 | | based on age, ancestry, color, creed, disability, domestic | 7 | | partnership or civil union status, ethnicity, gender | 8 | | identity or expression, health insurance status, marital | 9 | | status, national origin, nationality, place of residence, | 10 | | race, sex, sexual orientation, or socioeconomic status if | 11 | | the characteristics are not relevant to the patient's | 12 | | medical diagnosis and treatment.
| 13 | | Section 99. Effective date. This Act takes effect upon | 14 | | becoming law.
