Amends the Illinois Vehicle Code. Defines "highly automated work zone vehicle" and "remote autonomous vehicle operator". Provides that a provision related to following too closely shall not apply to the operation of a highly automated work zone vehicle. Provides that the Toll Highway Authority shall establish a 2-year highly automated work zone vehicle pilot program. Provides that the Authority shall annually report to the Governor and the General Assembly on the outcomes and the effectiveness of the program. Effective immediately.

| 2 | | Be it enacted by the People of the State of Illinois,
| 3 | | represented in the General Assembly:
| 4 | | Section 5. The Illinois Vehicle Code is amended by changing | 5 | | Section 11-710 and by adding Sections 1-125.1, 1-171.01c-1, | 6 | | 6-123, and 11-1433 as follows: | 7 | | (625 ILCS 5/1-125.1 new) | 8 | | Sec. 1-125.1. Highly automated work zone vehicle. A level 2 | 9 | | autonomous vehicle, as defined by SAE standard J3016, used in a | 10 | | construction or maintenance work zone under the jurisdiction of | 11 | | the Illinois State Toll Highway Authority to operate a shadow | 12 | | vehicle that protects workers, that is: | 13 | | (1) equipped with an automated driving system; and | 14 | | (2) remotely connected to a remote autonomous vehicle | 15 | | operator in a lead vehicle allowing for coordinated or | 16 | | controlled movement of the highly automated work zone | 17 | | vehicle within the line of sight of the operator. | 18 | | (625 ILCS 5/1-171.01c-1 new) | 19 | | Sec. 1-171.01c-1. Remote autonomous vehicle operator. A | 20 | | licensed driver trained as the remote operator of a highly | 21 | | automated work zone vehicle. |

A remote | 3 | | autonomous vehicle operator shall be a licensed driver trained | 4 | | by the manufacturer of a highly automated work zone vehicle in | 5 | | the remote operation of that vehicle while within line of sight | 6 | | of the operator.

| 8 | | Sec. 11-710. Following too closely. (a) The driver of
a | 9 | | motor vehicle shall not follow another vehicle more closely
| 10 | | than is reasonable and prudent, having due regard for the
speed | 11 | | of such vehicles and the traffic upon and the condition of the | 12 | | highway.
| 13 | | (b) The driver of any truck or motor vehicle
drawing | 14 | | another vehicle
when traveling upon a roadway outside of a | 15 | | business or
residence district and which is following another | 16 | | truck or
motor vehicle drawing another vehicle shall,
whenever | 17 | | conditions permit, leave sufficient space so that
an overtaking | 18 | | vehicle may enter and occupy such space without
danger, except | 19 | | that this shall not prevent a truck or motor
vehicle drawing | 20 | | another vehicle from overtaking and passing
any vehicle or | 21 | | combination of vehicles.
| 22 | | (c) Motor vehicles being driven upon any roadway outside
of | 23 | | a business or residence district in a caravan or
motorcade | 24 | | whether or not towing other vehicles shall be so
operated as to | 25 | | allow sufficient space between each such
vehicle or combination |

| 1 | | of vehicles so as to enable any other
vehicle to enter and | 2 | | occupy such space without danger. This
provision shall not | 3 | | apply to funeral processions.
| 4 | | (d) This Section does not apply to the operation of a | 5 | | highly automated work zone vehicle. | 6 | | (Source: P.A. 79-1069.)
| 7 | | (625 ILCS 5/11-1433 new) | 8 | | Sec. 11-1433. Highly automated work zone vehicle pilot | 9 | | program. | 10 | | (a) The Illinois State Toll Highway Authority shall | 11 | | establish a 2-year highly automated work zone vehicle pilot | 12 | | program. Under the program, the Authority may authorize a local | 13 | | government, with respect to roads under its jurisdiction, to | 14 | | deploy a highly automated work zone vehicle in a construction | 15 | | or maintenance work zone. | 16 | | (b) Beginning June 1, 2021, the Authority shall provide an | 17 | | annual report to the Governor and the General Assembly on the | 18 | | outcomes and the effectiveness of the program that shall | 19 | | include the following: | 20 | | (1) instances, if any, in which the highly automated | 21 | | work zone vehicle was struck while engaged in a designated | 22 | | highly automated work zone; | 23 | | (2) instances, if any, in which personnel were injured | 24 | | on the job while working in a designated construction or | 25 | | maintenance work zone; |

| 1 | | (3) cost savings due to the implementation of the | 2 | | highly automated work zone vehicle; | 3 | | (4) the types of training that the designated remote | 4 | | autonomous vehicle operator has undergone to properly | 5 | | control the highly automated work zone vehicle; and | 6 | | (5) instances, if any, of system malfunctions while the | 7 | | highly automated work zone vehicle was engaged, and how the | 8 | | operator responded to the situation. | 9 | | (c) This Section is repealed on January 1, 2024.
| 10 | | Section 99. Effective date. This Act takes effect upon | 11 | | becoming law.
