1 AN ACT concerning highways.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Illinois Highway Code is amended by
5 adding Section 4-219 as follows:
6 (605 ILCS 5/4-219 new)
7 Sec. 4-219. Transfer of property from the Illinois State
8 Toll Highway Authority. On or before December 31, 2003, the
9 Illinois State Toll Highway Authority shall transfer all of
10 its records, documents, property, and assets to the
11 Department. The Department shall succeed to all rights and
12 interests of the Illinois State Toll Highway Authority at the
13 close of the Illinois State Toll Highway Authority's business
14 on December 31, 2003, including any right or interest
15 relating to any cause of action then in existence. The
16 Department shall take over management and operation of the
17 existing toll highways in the State and shall be authorized
18 to establish tolls, rates, and charges for use of the
19 highways and pledge the income from the toll highways, after
20 maintenance and operation costs, to the outstanding
21 indebtedness incurred by the Illinois State Toll Highway
22 Authority.
23 Section 10. The Toll Highway Act is amended by adding
24 Section 40 as follows:
25 (605 ILCS 10/40 new)
26 Sec. 40. Abolishing the Authority.
27 (a) It is the intention and purpose of this amendatory
28 Act of the 93rd General Assembly that the Authority shall be
29 abolished and the terms of its chairman and directors holding

1 office shall expire on January 1, 2004. At that time, the
2 management and operation of the existing toll highways shall
3 be transferred to the Illinois Department of Transportation.
4 (b) All duties and obligations, together with all
5 records, documents, property, and assets, of the Authority
6 shall be transferred to the Illinois Department of
7 Transportation at the close of business on December 31, 2003.
8 (c) All powers of the Authority, including the power to
9 issue bonds, shall be transferred to the Illinois Department
10 of Transportation at the close of business on December 31,
11 2003.
12 (d) All employees of the Authority on December 31, 2003
13 shall become employees of the Illinois Department of
14 Transportation, subject to layoff or reorganization by the
15 Illinois Department of Transportation.
16 (e) On or before December 31, 2003, the Authority shall
17 terminate the Illinois State Toll Highway Authority Defined
18 Benefit Pension Plan and distribute the assets of the plan in
19 accordance with the terms of the plan and any other
20 requirements imposed by State or federal law.
21 (f) On and after January 1, 2004, the advisory committee
22 created under Section 3.1 shall meet with the Illinois
23 Department of Transportation and shall advise it on all
24 matters relating to policy and the administration of the toll
25 highway system. By January 1, 2015, the advisory committee
26 shall provide recommendations to the Illinois Department of
27 Transportation regarding the existing toll highways becoming
28 freeways by January 1, 2015 or sooner.
29 Section 99. Effective date. This Act takes effect upon
30 becoming law.
