Amends the Illinois Emergency Management Agency Act. Authorizes the Agency to perform the "common administrative functions" that were transferred from the Agency to the Department of Corrections by Executive Order Number 6 of 2006. Provides for transfer of the related property, records, contracts, unexpended appropriations, and pending business back to the Agency. Effective immediately.

| AN ACT concerning State government.
| 2 |
| Be it enacted by the People of the State of Illinois,
| 3 |
| represented in the General Assembly:
| 4 |
| Section 5. The Illinois Emergency Management Agency Act is | 5 |
| amended by adding Section 19.5 as follows: | 6 |
| (20 ILCS 3305/19.5 new) | 7 |
| Sec. 19.5. Common administrative functions of the Agency. | 8 |
| (a) The General Assembly finds and declares that Executive | 9 |
| Order Number 6 of 2006: | 10 |
| (1) defined "common administrative functions" to | 11 |
| include human resources, personnel, payroll, timekeeping, | 12 |
| procurement, and financial processes; | 13 |
| (2) transferred the common administrative functions of | 14 |
| the Illinois Emergency Management Agency to the Division of | 15 |
| Shared Services of the Department of Corrections; | 16 |
| (3) also transferred personnel, property, records, | 17 |
| contracts, appropriations, and pending business of the | 18 |
| Agency relating to the transferred common administrative | 19 |
| functions; and | 20 |
| (4) has resulted in unacceptable bureaucratic | 21 |
| obstacles and delays to the Agency in performing its | 22 |
| mission of providing funding and other needed assistance to | 23 |
| units of local government and other entities attempting to |

| cope with emergency situations. | 2 |
| (b) The common administrative functions that were | 3 |
| transferred from the Illinois Emergency Management Agency to | 4 |
| the Division of Shared Services of the Department of | 5 |
| Corrections by Executive Order Number 6 of 2006, and all | 6 |
| powers, rights, and duties pertaining to those functions, shall | 7 |
| be transferred back to the Illinois Emergency Management Agency | 8 |
| on July 1, 2009. | 9 |
| (c) The personnel, property, records, contracts, and | 10 |
| pending business that were transferred from the Illinois | 11 |
| Emergency Management Agency to the Division of Shared Services | 12 |
| of the Department of Corrections by Executive Order Number 6 of | 13 |
| 2006 shall be transferred back to the Illinois Emergency | 14 |
| Management Agency on July 1, 2009, together with all additional | 15 |
| property, records, contracts, current unexpended | 16 |
| appropriations, and pending business relating to the common | 17 |
| administrative functions of the Agency that have arisen since | 18 |
| the time of the transfer of those functions to the Division of | 19 |
| Shared Services. | 20 |
| (d) To the extent that it conflicts with this Section, | 21 |
| Executive Order Number 6 of 2006 is superseded.

| Section 99. Effective date. This Act takes effect upon | 23 |
| becoming law.
