Amends the Illinois Vehicle Code. Defines "M998 HMMWV" as an AM General Series M998 High-Mobility Multipurpose Wheeled Vehicle produced for military or government use. Provides that the owner of an M998 HMMWV may register the vehicle as a former military vehicle if specified conditions are met. Provides that a certificate of title issued for an M998 HMMWV shall not indicate that the M998 HMMWV is limited to off-road use.

| 2 | | Be it enacted by the People of the State of Illinois,
| 3 | | represented in the General Assembly:
| 4 | | Section 5. The Illinois Vehicle Code is amended by adding | 5 | | Sections 1-140.20 and 3-122 and by changing Section 3-804.3 as | 6 | | follows: | 7 | | (625 ILCS 5/1-140.20 new) | 8 | | Sec. 1-140.20. M998 HMMWV. An AM General Series M998 | 9 | | High-Mobility Multipurpose Wheeled Vehicle produced for | 10 | | military or government use. | 11 | | (625 ILCS 5/3-122 new) | 12 | | Sec. 3-122. M998 HMMWV; certificate of title. A | 13 | | certificate of title issued for an M998 HMMWV shall not | 14 | | indicate that the M998 HMMWV is limited to off-road use if the | 15 | | applicant for the certificate of title and the M998 HMMWV meet | 16 | | the requirements of paragraph (1) of subsection (e) of Section | 17 | | 3-804.3. | 18 | | (625 ILCS 5/3-804.3) | 19 | | Sec. 3-804.3. Former military vehicles. | 20 | | (a) The owner of a former military vehicle may register | 21 | | the vehicle for a fee not to exceed: |

| 1 | | (1) $100 for a vehicle with a gross vehicle weight | 2 | | rating of 26,000 pounds or less; | 3 | | (2) $150 for a vehicle with a gross vehicle weight | 4 | | rating of 26,001 to 45,000 pounds; | 5 | | (3) $500 for a vehicle with a gross vehicle weight | 6 | | rating of 45,001 to 65,000 pounds; | 7 | | (4) $1,000 for a vehicle with a gross vehicle weight | 8 | | rating of over 65,000 pounds; or | 9 | | (5) $25 for a trailer with a weight of 3,000 pounds or | 10 | | less; or | 11 | | (6) $75 for a trailer with a weight of over 3,000 | 12 | | pounds. | 13 | | (b) The Secretary may prescribe, in the Secretary's | 14 | | discretion, that former military vehicle plates be issued for | 15 | | a definite or an indefinite term, such term to correspond to | 16 | | the term of registration plates issued generally, as provided | 17 | | in Section 3-414.1. Any person requesting former military | 18 | | vehicle plates under this Section may also apply to have | 19 | | vanity or personalized plates as provided under Section | 20 | | 3-405.1. | 21 | | (c) A vehicle registered as a former military vehicle is | 22 | | not subject to Section 3-815 and 3-818 of this Code. | 23 | | (d) A vehicle may not be registered under this Section | 24 | | unless a title for the vehicle has been issued by the Secretary | 25 | | and the vehicle is eligible for registration without regard to | 26 | | its status as a military vehicle.

| 1 | | (e)(1) Notwithstanding subsection (d), the owner of an | 2 | | M998 HMMWV may register the vehicle as a former military | 3 | | vehicle if: | 4 | | (A) the owner is a former or current member of the | 5 | | United States Armed Forces who provides proof to the | 6 | | Secretary that he or she possesses or formerly possessed a | 7 | | military license to operate the vehicle; | 8 | | (B) before registration, the M998 HMMWV successfully | 9 | | completes an inspection by the Secretary regarding the | 10 | | suitability for limited use of the M998 HMMWV upon the | 11 | | highways of this State as set forth in paragraph (2). The | 12 | | fee for the inspection shall not exceed $50. The | 13 | | Secretary, in the Secretary's discretion, may accept the | 14 | | owner's affidavit regarding safety modifications and | 15 | | equipment standards
in lieu of the inspection. The | 16 | | Secretary shall give the owner a temporary registration so | 17 | | that the owner may drive the M998 HMMWV on a direct route | 18 | | to and from the inspection point; | 19 | | (C) a keyed ignition cutoff switch is installed in the | 20 | | M998 HMMWV; and | 21 | | (D) a battery power cutoff switch is installed in the | 22 | | M998 HMMWV. | 23 | | (2) Operation of a registered M998 HMMWV upon the highways | 24 | | of this State is permitted only if: | 25 | | (A) operation of the M998 HMMWV is limited to | 26 | | ceremonies, parades, and educational events and |

| 1 | | transportation to and from ceremonies, parades, and | 2 | | educational events; | 3 | | (B) the operator, if not the owner, meets the | 4 | | requirements of subparagraph (B) of paragraph (1); and | 5 | | (C) at all times when operating the M998 HMMWV, the | 6 | | operator is accompanied by an assistant driver who | 7 | | possesses a valid State driver's license. | 8 | | (Source: P.A. 97-811, eff. 7-13-12.)
