|
Amends the Medical Practice Act and the Wholesale Drug Distribution Licensing Act. In any calendar year, prohibits a physician from intentionally soliciting or accepting from a manufacturer and a manufacturer from intentionally conferring upon a physician any gift having a cumulative total value of more than $50. Excludes drug product samples and educational materials from the ban.

| AN ACT concerning regulation.

| Be it enacted by the People of the State of Illinois,
| 3 |
| represented in the General Assembly:
| 4 |
| Section 5. The Medical Practice Act of 1987 is amended by | 5 |
| adding Section 33.5 as follows: | 6 |
| (225 ILCS 60/33.5 new) | 7 |
| Sec. 33.5. Gift ban. | 8 |
| (a) In this Section: | 9 |
| "Gift" means any gratuity, discount, entertainment, | 10 |
| hospitality, loan, forbearance, or other tangible or | 11 |
| intangible item having monetary value including, but not | 12 |
| limited to, cash, food, and drink. "Gift" does not include | 13 |
| drug product samples or educational materials. | 14 |
| "Manufacturer" has the meaning given to the term in the | 15 |
| Wholesale Drug Distribution Licensing Act. | 16 |
| (b) During any calendar year, no physician licensed under | 17 |
| this Act shall intentionally solicit or accept any gift or | 18 |
| gifts from a drug manufacturer having a cumulative total value | 19 |
| of more than $50. | 20 |
| Section 10. The Wholesale Drug Distribution Licensing Act | 21 |
| is amended by adding Section 56.5 as follows: |
