Amends the Department of Public Health Powers and Duties Law of the Civil Administrative Code of Illinois. Makes a technical change in a Section concerning the Chronic Kidney Disease Program.

| 2 | | Be it enacted by the People of the State of Illinois,
| 3 | | represented in the General Assembly:
| 4 | | Section 5. The Department of Public Health Powers and | 5 | | Duties Law of the
Civil Administrative Code of Illinois is | 6 | | amended by changing Section 2310-339 as follows: | 7 | | (20 ILCS 2310/2310-339) | 8 | | Sec. 2310-339. Chronic Kidney Disease Program. | 9 | | (a) The The Department, subject to appropriation or other | 10 | | available funding, shall establish a Chronic Kidney Disease | 11 | | Awareness, Testing, Diagnosis and Treatment Program. The | 12 | | program may include, but is not limited to:
| 13 | | (1) Dissemination of information regarding the | 14 | | incidence of chronic kidney disease, the risk factors | 15 | | associated with chronic kidney disease, and the benefits of | 16 | | early testing, diagnosis and treatment of chronic kidney | 17 | | disease.
| 18 | | (2) Promotion information and counseling about | 19 | | treatment options.
| 20 | | (3) Establishment and promotion of referral services | 21 | | and testing programs.
| 22 | | (4) Development and dissemination, through print and | 23 | | broadcast media, of public service announcements that |

| 1 | | publicize the importance of awareness, testing, diagnosis | 2 | | and treatment of chronic kidney disease.
| 3 | | (b) Any entity funded by the Program shall coordinate with | 4 | | other local providers of chronic kidney disease testing, | 5 | | diagnostic, follow-up, education, and advocacy services to | 6 | | avoid duplication of effort. Any entity funded by the Program | 7 | | shall comply with any applicable State and federal standards | 8 | | regarding chronic kidney disease testing.
| 9 | | (c) Administrative costs of the Department shall not exceed | 10 | | 10% of the funds allocated to the Program. Indirect costs of | 11 | | the entities funded by this Program shall not exceed 12%. The | 12 | | Department shall define "indirect costs" in accordance with | 13 | | applicable State and federal law.
| 14 | | (d) Any entity funded by the Program shall collect data and | 15 | | maintain records that are determined by the Department to be | 16 | | necessary to facilitate the Department's ability to monitor and | 17 | | evaluate the effectiveness of the entities and the Program. | 18 | | Commencing with the Program's second year of operation, the | 19 | | Department shall submit an annual report to the General | 20 | | Assembly and the Governor. The report shall describe the | 21 | | activities and effectiveness of the Program and shall include, | 22 | | but is not limited to, the following types of information | 23 | | regarding those persons served by the Program: (i) the number, | 24 | | (ii) the ethnic, geographic, and age breakdown, (iii) the | 25 | | stages of progression, and (iv) the diagnostic and treatment | 26 | | status.

| 1 | | (e) The Department or any entity funded by the Program | 2 | | shall collect personal and medical information necessary to | 3 | | administer the Program from any individual applying for | 4 | | services under the Program. The information shall be | 5 | | confidential and shall not be disclosed other than for purposes | 6 | | directly connected with the administration of the Program or as | 7 | | otherwise provided by law or pursuant to prior written consent | 8 | | of the subject of the information.
| 9 | | (f) The Department or any entity funded by the Program may | 10 | | disclose the confidential information to medical personnel and | 11 | | fiscal intermediaries of the State to the extent necessary to | 12 | | administer the Program, and to other State public health | 13 | | agencies or medical researchers if the confidential | 14 | | information is necessary to carry out the duties of those | 15 | | agencies or researchers in the investigation, control, or | 16 | | surveillance of chronic kidney disease.
| 17 | | (g) The Department shall adopt rules to implement the | 18 | | Program in accordance with the Illinois Administrative | 19 | | Procedure Act.
