Amends the Barber, Cosmetology, Esthetics, Hair Braiding, and Nail Technology Act of 1985. Provides that the continuing education requirement for cosmetologists does not apply to licensees who are 62 years or older or licensees that have been licensed as a cosmetologist for at least 25 years.

| 2 | | Be it enacted by the People of the State of Illinois,
| 3 | | represented in the General Assembly:
| 4 | | Section 5. The Barber, Cosmetology, Esthetics, Hair | 5 | | Braiding, and Nail
Technology Act of 1985 is amended by | 6 | | changing Section 3-7 as follows:
| 7 | | (225 ILCS 410/3-7) (from Ch. 111, par. 1703-7)
| 8 | | (Section scheduled to be repealed on January 1, 2026)
| 9 | | Sec. 3-7. Licensure; renewal; continuing education. The
| 10 | | holder of a license issued under this Article III may renew | 11 | | that license during
the month preceding the expiration date | 12 | | thereof by paying the required fee,
giving such evidence as the | 13 | | Department may prescribe of completing not less
than 14 hours | 14 | | of continuing education for a cosmetologist, and 24 hours of
| 15 | | continuing education for a cosmetology teacher or cosmetology | 16 | | clinic teacher,
within the 2 years prior to renewal. The | 17 | | training shall be in subjects
approved by the Department as | 18 | | prescribed by rule upon recommendation of the Board and may | 19 | | include online instruction. | 20 | | For the initial renewal of a cosmetologist's license which | 21 | | requires continuing education, as prescribed by rule, one hour | 22 | | of the continuing education shall include domestic violence and | 23 | | sexual assault awareness education as prescribed by rule of the |

| 1 | | Department. For every subsequent renewal of a cosmetologist's | 2 | | license, one hour of the continuing education may include | 3 | | domestic violence and sexual assault awareness education as | 4 | | prescribed by rule of the Department. The one-hour domestic | 5 | | violence and sexual assault awareness continuing education | 6 | | course shall be provided by a continuing education provider | 7 | | approved by the Department, except that completion from March | 8 | | 12, 2016 to March 15, 2016 of a one-hour domestic violence and | 9 | | sexual assault awareness course from a domestic violence and | 10 | | sexual assault awareness organization shall satisfy this | 11 | | requirement.
| 12 | | The Department may prescribe rules regarding the | 13 | | requirements for domestic violence and sexual assault | 14 | | awareness continuing education courses and teachers. | 15 | | The Department shall establish by rule a means for the | 16 | | verification of
completion of the continuing education | 17 | | required by this Section. This
verification may be accomplished | 18 | | through audits of records maintained by
registrants, by | 19 | | requiring the filing of continuing education certificates with
| 20 | | the Department, or by other means established by the | 21 | | Department.
| 22 | | The Department, in its discretion, may waive
enforcement of | 23 | | the continuing education requirement in this Section, | 24 | | including the domestic violence and sexual assault awareness | 25 | | education requirement, and
shall adopt rules defining the | 26 | | standards and criteria for
that waiver under the following |

| 1 | | circumstances:
| 2 | | (a) the licensee resides in a locality where it is | 3 | | demonstrated that the
absence of opportunities for such | 4 | | education would interfere with the
ability of the licensee | 5 | | to provide service to the public;
| 6 | | (b) that to comply with the continuing education | 7 | | requirements would
cause a substantial financial hardship | 8 | | on the licensee;
| 9 | | (c) that the licensee is serving in the United States | 10 | | Armed Forces; or
| 11 | | (d) that the licensee is incapacitated due to illness.
| 12 | | The continuing education requirements of this Section do | 13 | | not apply to a licensee who is 62 years of age or older or has | 14 | | been licensed as a cosmetologist for at least 25 years. | 15 | | (Source: P.A. 98-911, eff. 1-1-15; 99-427, eff. 8-21-15; | 16 | | 99-766, eff. 1-1-17 .)
