Amends the Illinois Municipal Code. Provides that a municipality shall provide free snow removal at the residence of a person with a disability, senior, or veteran when one inch or more of snow accumulates on the ground. Provides that a person with a disability, senior, or veteran may receive free snow removal under these provisions only after he or she registers with the municipality providing the following information to the municipality: identification; proof of current residence; and, if applicable, signing a statement affirming that he or she is a person with a disability or a veteran. Defines terms. Limits home rule powers. Effective July 1, 2019.

| 2 | | Be it enacted by the People of the State of Illinois,
| 3 | | represented in the General Assembly:
| 4 | | Section 5. The Illinois Municipal Code is amended by adding | 5 | | Section 11-30-8.5 as follows: | 6 | | (65 ILCS 5/11-30-8.5 new) | 7 | | Sec. 11-30-8.5. Free snow removal. | 8 | | (a) As used in this Section: | 9 | | "Free snow removal" means shoveling and salting a | 10 | | residence's driveway. | 11 | | "Person with a disability" means a person who suffers from | 12 | | a permanent physical or mental impairment resulting from | 13 | | disease, injury, functional disorder or congenital condition. | 14 | | "Residence" means a single-family residence occupied by a | 15 | | person with a disability, senior, or veteran. | 16 | | "Senior" means a person 65 years of age or older. | 17 | | "Veteran" means an Illinois resident who has served as a | 18 | | member of the United States Armed Services on active duty, a | 19 | | member of the Illinois National Guard, or a member of the | 20 | | United States Reserve Forces, and who has received an honorable | 21 | | discharge. | 22 | | (b) A municipality shall provide free snow removal at the | 23 | | residence of a person with a disability, senior, or veteran |

| 1 | | that has registered under subsection (c) when one inch or more | 2 | | of snow accumulates on the ground. | 3 | | (c) A person with a disability, senior, or veteran may | 4 | | receive free snow removal under this Section only after he or | 5 | | she registers with the municipality providing the following | 6 | | information to the municipality: | 7 | | (1) identification; | 8 | | (2) proof of current residence; and | 9 | | (3) signing a statement affirming that he or she is a | 10 | | person with a disability or a veteran, if applicable. | 11 | | (d) A home rule municipality shall provide free snow | 12 | | removal to persons with a disability, seniors, and veterans in | 13 | | a manner no less restrictive than required in this Section. | 14 | | This Section is a limitation under subsection (i) of Section 6 | 15 | | of Article VII of the Illinois Constitution on the concurrent | 16 | | exercise by home rule units of powers and functions exercised | 17 | | by the State.
| 18 | | Section 99. Effective date. This Act takes effect July 1, | 19 | | 2019.
