Amends the Interior Design Title Act. Changes the number of members on the Board of Interior Design Professionals from 5 to 7. Removes a provision concerning initial Board appointments and the requirement that certain Board members be a member of the profession for a period of at least 5 years. Provides that a majority of Board members then appointed constitutes a quorum and that a majority vote of the quorum is required for a Board decision. Removes the grandfather provision from a Section concerning the requirements for registration under the Act. Effective immediately.

| AN ACT concerning regulation.
| 2 |
| Be it enacted by the People of the State of Illinois,
| 3 |
| represented in the General Assembly:
| 4 |
| Section 5. The Interior Design Title Act is amended by | 5 |
| changing Sections 6 and 8 as follows:

| Sec. 6. Board of Interior Design Professionals. There is | 9 |
| created a
Board of Interior Design Professionals to be composed | 10 |
| of persons designated
from time to time by the Director, as | 11 |
| follows:
| 12 |
| (a) Seven
For the first year, 5 persons, 4 of whom are
have | 13 |
| been interior
designers , 2 of whom are registered residential | 14 |
| interior designers
for a period of 5 years or more who would | 15 |
| qualify upon
application to the Department under this Act to be
| 16 |
| registered interior designers , and one public member. After the | 17 |
| initial
appointments, each interior design member shall hold a | 18 |
| valid interior
design registration. After the effective date of | 19 |
| this amendatory Act of
1994, 2 additional persons shall be | 20 |
| appointed to the Board who have been
residential interior | 21 |
| designers for a period of 5 years or more and who would
qualify | 22 |
| upon application under this Act to be registered as a | 23 |
| residential
interior designer. After the initial appointments | 24 |
| of the 2 additional members,
each residential interior designer | 25 |
| member shall hold a valid residential
interior designer | 26 |
| registration. The Board shall annually elect a chairman.
| 27 |
| (b) Terms for all members shall be 3 years. For initial
| 28 |
| appointments, one member shall be appointed to serve for one | 29 |
| year, 2
shall be appointed to serve for 2 years, and the | 30 |
| remaining shall be
appointed to serve for 3 years and until | 31 |
| their successors are appointed
and qualified. Initial terms | 32 |
| shall begin on the effective date of this
Act. For the initial |

| appointments of the 2 additional members added by this
| 2 |
| amendatory Act of 1994, one shall be appointed to serve for one | 3 |
| year and the
other to serve for 2 years, and until their | 4 |
| successors are appointed and
qualified. Partial terms over 2 | 5 |
| years in length shall be considered as full
terms. A member may | 6 |
| be reappointed for a successive term, but no member shall
serve | 7 |
| more than 2 full terms.
| 8 |
| (c) The membership of the Board should reasonably reflect | 9 |
| representation
from the various geographic areas of the State.
| 10 |
| (d) In making appointments to the Board, the Director shall | 11 |
| give due
consideration to recommendations by national and state | 12 |
| organizations of the
interior design profession and the | 13 |
| residential interior design profession,
and shall promptly | 14 |
| give due notice to such organizations of any vacancy in the
| 15 |
| membership of the Board. The Director may terminate the | 16 |
| appointment of any
member for any cause, which in the opinion | 17 |
| of the Director, reasonably
justifies such termination.
| 18 |
| (e) A vacancy in the membership of the Board shall not | 19 |
| impair the right
of a quorum to exercise all the rights and | 20 |
| perform all the duties of the Board. A majority of Board | 21 |
| members then appointed constitutes a quorum. A majority vote of | 22 |
| the quorum is required for a Board decision.
| 23 |
| (f) The members of the Board shall each receive as | 24 |
| compensation a
reasonable sum as determined by the Director for | 25 |
| each day actually engaged
in the duties of the office, and all | 26 |
| legitimate and necessary expenses
incurred in attending the | 27 |
| meeting of the Board.
| 28 |
| (g) Members of the Board shall be immune from suit in any | 29 |
| action based
upon any disciplinary proceedings or other | 30 |
| activities performed in good
faith as members of the Board.

| Sec. 8. Requirements for registration.
| 35 |
| (a) Each applicant for registration shall apply to the |
|

| Department in
writing on a form provided by the Department. | 2 |
| Except as otherwise provided in
this Act, each applicant shall | 3 |
| take and pass the examination approved by the
Department. Prior | 4 |
| to registration, the applicant shall provide substantial
| 5 |
| evidence to the Board that the applicant:
| 6 |
| (1) is a graduate of a 5 year interior design program | 7 |
| from an
accredited institution and has completed at least 2 | 8 |
| years of full time
diversified interior design experience;
| 9 |
| (2) is a graduate of a 4 year interior design program | 10 |
| from an
accredited institution and has completed at least 2 | 11 |
| years of full time
diversified interior design experience;
| 12 |
| (3) has completed at least 3 years of interior design | 13 |
| curriculum
from an accredited institution and has | 14 |
| completed 3 years of full time
diversified interior design | 15 |
| experience;
| 16 |
| (4) is a graduate of a 2 year interior design program | 17 |
| from an
accredited institution and has completed 4 years of | 18 |
| full time diversified
interior design experience; or
| 19 |
| (5) holds a high school diploma or GED and has | 20 |
| completed 5 years of full
time diversified residential | 21 |
| interior design experience.
| 22 |
| (b) In addition to providing evidence of meeting the | 23 |
| requirements of
subsection (a):
| 24 |
| (1) Each applicant for registration as an interior | 25 |
| designer shall
provide substantial evidence that he or she | 26 |
| has successfully completed the
examination administered by | 27 |
| the National Council for Interior Design
Qualifications.
| 28 |
| (2) Each applicant for registration as a residential | 29 |
| interior designer
shall provide substantial evidence that | 30 |
| he or she has successfully completed
the examination | 31 |
| administered by the Council for Qualification of | 32 |
| Residential
Interior Designers.
| 33 |
| Examinations for applicants under this Act may be held at | 34 |
| the direction of
the Department from time to time but not less | 35 |
| than once each year. The scope
and form of the examination | 36 |
| shall conform to the National Council for Interior
Design |

| Qualification examination for interior designers and the | 2 |
| Council for
Qualification of Residential Interior Designers | 3 |
| for residential interior
designers.
| 4 |
| Each applicant for registration who possesses the | 5 |
| necessary
qualifications shall pay to the Department the | 6 |
| required registration fee,
which is not refundable.
| 7 |
| An individual applying for registration shall have 3 years | 8 |
| from the
date of application to complete the application | 9 |
| process. If the process
has not been completed in 3 years, the | 10 |
| application shall be denied and the
fee forfeited. The | 11 |
| applicant may reapply, but shall meet the requirements
in | 12 |
| effect at the time of reapplication.
| 13 |
| (c) (Blank).
If any applicant applies for registration | 14 |
| between January 1, 1993, and
January 31, 1993, and had | 15 |
| completed by June 30, 1992 at least 8 years of full
time, | 16 |
| diversified professional experience in interior design or a | 17 |
| combination
of full time experience and interior design | 18 |
| education to equal 8 years, the
applicant may be issued a | 19 |
| certificate of registration without examination.
Registration | 20 |
| under this subsection shall be subject to the Board's
| 21 |
| discretionary review of the experience qualification.
| 22 |
| Notwithstanding any other provisions in this Act, anyone | 23 |
| who has submitted
an application within 5 days after the | 24 |
| effective date of this amendatory Act of
1994 and has completed | 25 |
| at least 15 years of full-time, diversified professional
| 26 |
| experience in interior design may be issued a certificate of | 27 |
| registration
without examination.
| 28 |
| (c-5) If any applicant applies for registration as a | 29 |
| residential interior
designer within one year after the | 30 |
| effective date of this amendatory Act of
1994 and has completed | 31 |
| at least 5 years of full time, diversified professional
| 32 |
| experience in residential interior design or a combination of | 33 |
| full time
experience and residential interior design education | 34 |
| equal to 5 years, the
applicant may be issued a certificate of | 35 |
| registration without examination.
Registration under this | 36 |
| subsection shall be subject to the Board's
discretionary review |

| of the experience qualification.
| 2 |
| (d) Upon payment of the required fee, which shall be | 3 |
| determined by rule,
an applicant who is an architect licensed | 4 |
| under the laws of this State may,
without examination, be | 5 |
| granted registration as an interior designer or
residential | 6 |
| interior designer by the Department provided the applicant | 7 |
| submits
proof of an active architectural license in Illinois.
| 8 |
| (e) An interior designer registered under the laws of this | 9 |
| State may,
without examination or re-application, use the title | 10 |
| "Residential Interior
Designer".

| 13 |
| Section 99. Effective date. This Act takes effect upon | 14 |
| becoming law.
