|
Amends the Counties Code and the Illinois Municipal Code. Provides that, by no later than April 1, 2011, a county with a population over 500,000 or a municipality with a population over 100,000 must acquire and maintain a gunshot location system to assist law enforcement agencies. Sets forth the requirements for the gunshot location system. Defines "gunshot location system". Limits home rule powers. Effective January 1, 2011.

| AN ACT concerning local government.

| Be it enacted by the People of the State of Illinois,
| 3 |
| represented in the General Assembly:

| Section 5. The Counties Code is amended by adding Section | 5 |
| 5-1132 as follows: | 6 |
| (55 ILCS 5/5-1132 new) | 7 |
| Sec. 5-1132. Gunshot location system. By no later than | 8 |
| April 1, 2011, a county with a population over 500,000 must | 9 |
| acquire and maintain a gunshot location system to assist law | 10 |
| enforcement agencies within the county. The gunshot location | 11 |
| system must cover at least one square mile within the county in | 12 |
| which there is significant gunshot activity. The gunshot | 13 |
| location system must meet the guidelines established by the | 14 |
| United States Department of Homeland Security. A county must | 15 |
| create a database to log gunshot incidents within the area | 16 |
| covered by the system. | 17 |
| A home rule unit may not adopt gunshot location system | 18 |
| requirements that are less restrictive than this Section. This | 19 |
| Section is a limitation under subsection (i) of Section 6 of | 20 |
| Article VII of the Illinois Constitution on the concurrent | 21 |
| exercise by home rule units of the powers and functions | 22 |
| exercised by the State. | 23 |
| For the purposes of this Section, "gunshot location system" |

| means a network consisting of deployed acoustic sensors and one | 2 |
| or more processing nodes for data integration and analysis. The | 3 |
| network must (i) be capable of being tuned to one or more | 4 |
| ranges of frequencies to detect sounds including without | 5 |
| limitation gunshots, heavy weapons discharge, explosions, and | 6 |
| vehicle noises, (ii) use acoustic triangulation to provide | 7 |
| accurate location data, (iii) be wired, wireless, or a hybrid, | 8 |
| and (iv) be capable of operation near critical infrastructure | 9 |
| assets or in wide areas. | 10 |
| Section 10. The Illinois Municipal Code is amended by | 11 |
| adding Section 11-1-12 as follows: | 12 |
| (65 ILCS 5/11-1-12 new) | 13 |
| Sec. 11-1-12. Gunshot location system. By no later than | 14 |
| April 1, 2011, a municipality with a population over 100,000 | 15 |
| must acquire and maintain a gunshot location system to assist | 16 |
| law enforcement agencies within the municipality. The gunshot | 17 |
| location system must cover at least one square mile within the | 18 |
| municipality in which there is significant gunshot activity. | 19 |
| The gunshot location system must meet the guidelines | 20 |
| established by the United States Department of Homeland | 21 |
| Security. A municipality must create a database to log gunshot | 22 |
| incidents within the area covered by the system. | 23 |
| A home rule municipality may not adopt gunshot location | 24 |
