Creates the Water Heater Safety Valve Act. Provides that a manufacturer or supplier of a hot water heater for use in a residential home or facility must supply or attach a temperature mixing valve or other safety valve to the hot water heater or tank that prevents water with a temperature above 120 degrees Fahrenheit from coming from any faucet or other source of water into direct contact with a person. Amends the Illinois Plumbing License Law to provide that a person engaged in plumbing who installs a hot water heater for use in a residential home or facility must supply or attach a temperature mixing valve or other safety valve to the hot water heater or tank that prevents water with a temperature above 120 degrees Fahrenheit from coming from any bathtub faucet, shower faucet, sink faucet, or any other source of water into direct contact with a person. Effective January 1, 2021.

| 1 | | AN ACT concerning safety.
| 2 | | Be it enacted by the People of the State of Illinois,
| 3 | | represented in the General Assembly:
| 4 | | Section 1. Short title. This Act may be cited as the Water | 5 | | Heater Safety Valve Act. | 6 | | Section 5. Temperature mixing valve or safety valve. A | 7 | | manufacturer or supplier of a water heater or tank for use in a | 8 | | residence or residential facility located in Illinois must | 9 | | supply or attach a temperature mixing valve or other safety | 10 | | valve to the water heater or tank that prevents water with a | 11 | | temperature above 120 degrees Fahrenheit from coming from any | 12 | | bathtub faucet, shower faucet, sink faucet, or any other source | 13 | | of water into direct contact with a person. | 14 | | Section 10. Enforcement and administration; civil | 15 | | penalties. | 16 | | (a) The Department of Public Health shall administer and | 17 | | enforce the provisions of this Act. | 18 | | (b) Any person or entity who violates this Act shall be | 19 | | liable for a civil penalty of $500 for the first violation and | 20 | | $1,000 for each subsequent violation. The State's Attorney of | 21 | | the county in which the violation occurred or the Attorney | 22 | | General may bring an action in the circuit court of the county |

| 1 | | in which the violation occurred to enforce the collection of | 2 | | any civil penalty imposed. | 3 | | Section 90. The Illinois Plumbing License Law is amended by | 4 | | changing Section 40 as follows:

| 6 | | Sec. 40.
All persons engaged in plumbing as defined in this | 7 | | Act shall
comply with the minimum code of standards for | 8 | | plumbing and the fixtures,
materials, design and installation | 9 | | methods of plumbing systems published
by the Department and | 10 | | filed with the Secretary of State as required by this Act.
| 11 | | All installations of equipment, fixtures, appliances or | 12 | | piping which
are used or intended for use entirely for or as a | 13 | | part of a water supply
system or sewage disposal system and | 14 | | thereby can affect the public health
shall comply with the | 15 | | provisions of the State Plumbing Code for design,
materials, | 16 | | installation and maintenance. The installation, repair, | 17 | | maintenance,
alteration or extension of building sewers shall | 18 | | be done in accordance
with the State Plumbing Code. Any person | 19 | | engaged in any of such work
shall upon investigation and | 20 | | determination of non-compliance with the provisions
of the | 21 | | State Plumbing Code be subject to the penalties contained in | 22 | | this
Act. Such prosecution shall be the responsibility of the | 23 | | State's Attorney
or other authority as authorized by this Act.
