| 2 | | Be it enacted by the People of the State of Illinois,
| 3 | | represented in the General Assembly:
| 4 | | Section 5. The Illinois Promotion Act is amended by | 5 | | changing Section 8b as follows: | 6 | | (20 ILCS 665/8b) | 7 | | Sec. 8b. Municipal convention center and sports facility | 8 | | attraction grants. | 9 | | (a) Until July 1, 2022 July 1, 2020 , the Department is | 10 | | authorized to make grants, subject to appropriation by the | 11 | | General Assembly, from the Tourism Promotion Fund to a unit of | 12 | | local government, municipal convention center, or convention | 13 | | center authority that provides incentives, as defined in | 14 | | subsection (i) of Section 3 of this Act, for the purpose of | 15 | | attracting conventions, meetings, and trade shows to municipal | 16 | | convention centers and attracting sporting events to municipal | 17 | | amateur sports facilities. Grants awarded under this Section | 18 | | shall be based on the net proceeds received under the Hotel | 19 | | Operators' Occupation Tax Act for the renting, leasing, or | 20 | | letting of hotel rooms in the municipality for the month in | 21 | | which the convention, meeting, trade show, or sporting event | 22 | | occurs. Grants shall not exceed 80% of the incentive amount | 23 | | provided by the unit of local government, municipal convention |

Further, in no event | 2 | | may the aggregate amount of grants awarded to a single | 3 | | municipal convention center, convention center authority, or | 4 | | municipal amateur sports facility exceed $200,000 in any | 5 | | calendar year. The Department may, by rule, require any other | 6 | | provisions it deems necessary in order to protect the State's | 7 | | interest in administering this program. | 8 | | (b) No later than May 15 of each year, through May 15, 2022 | 9 | | May 15, 2020 , the unit of local government, municipal | 10 | | convention center, or convention center authority shall | 11 | | certify to the Department the amounts of funds expended in the | 12 | | previous fiscal year to provide qualified incentives; however, | 13 | | in no event may the certified amount pursuant to this paragraph | 14 | | exceed $200,000 for any municipal convention center, | 15 | | convention center authority, or municipal amateur sports | 16 | | facility in any calendar year. The unit of local government, | 17 | | convention center, or convention center authority shall | 18 | | certify (A) the net proceeds received under the Hotel | 19 | | Operators' Occupation Tax Act for the renting, leasing, or | 20 | | letting of hotel rooms in the municipality for the month in | 21 | | which the convention, meeting, or trade show occurs and (B) the | 22 | | average of the net proceeds received under the Hotel Operators' | 23 | | Occupation Tax Act for the renting, leasing, or letting of | 24 | | hotel rooms in the municipality for the same month in the 3 | 25 | | immediately preceding years. | 1 | | shall include the incentive amounts as part of its regular | 2 | | audit. | 3 | | (b-5) Grants awarded to a unit of local government, | 4 | | municipal convention center, or convention center authority | 5 | | may be made by the Department of Commerce and Economic | 6 | | Opportunity from appropriations for those purposes for any | 7 | | fiscal year, without regard to the fact that the qualification | 8 | | or obligation may have occurred in a prior fiscal year. | 9 | | (c) The Department shall submit a report , which must be | 10 | | provided electronically, on the effectiveness of the program | 11 | | established under this Section to the General Assembly no later | 12 | | than January 1, 2022 January 1, 2020 .
