Creates the Construction Apprenticeship Program Act. Provides that, as a condition of engaging in a construction business in this State, a contractor must document proof of participation in an apprenticeship program approved by and registered with the United States Department of Labor's Bureau of Apprenticeship and Training. Imposes a penalty not to exceed $5,000 for a first violation and a penalty not to exceed $10,000 for subsequent violations. Provides for enforcement by the Department of Labor and authorizes the adoption of any rules necessary to implement the Act.

| 2 | | Be it enacted by the People of the State of Illinois,
| 3 | | represented in the General Assembly:
| 4 | | Section 1. Short title. This Act may be cited as the | 5 | | Construction Apprenticeship Program Act. | 6 | | Section 5. Definitions. In this Act: | 7 | | "Apprentice" means a participant in an apprenticeship | 8 | | program approved by and registered with the United States | 9 | | Department of Labor's Bureau of Apprenticeship and Training. | 10 | | "Apprenticeship program" means an apprenticeship and | 11 | | training program approved by and registered with the United | 12 | | States Department of Labor's Bureau of Apprenticeship and | 13 | | Training. | 14 | | "Construction" means any constructing, altering, | 15 | | reconstructing, repairing, rehabilitating, refinishing, | 16 | | refurbishing, remodeling, remediating, renovating, custom | 17 | | fabricating, maintenance, landscaping, improving, wrecking, | 18 | | painting, decorating, demolishing, and adding to or | 19 | | subtracting from any building, structure, highway, roadway, | 20 | | street, bridge, alley, sewer, ditch, sewage disposal plant, | 21 | | water works, parking facility, railroad, excavation or other | 22 | | structure, project, development, real property, or | 23 | | improvement, or to do any part thereof, whether or not the |

| 1 | | performance of the work herein described involves the addition | 2 | | to, or fabrication into, any structure, project, development, | 3 | | real property, or improvement herein described of any material | 4 | | or article of merchandise. Construction also includes moving | 5 | | construction related materials on the job site to or from the | 6 | | job site. | 7 | | "Contractor" means any individual, sole proprietor, | 8 | | partnership, firm, corporation, limited liability company, | 9 | | association or other legal entity permitted by law to do | 10 | | business within the State of Illinois that engages in | 11 | | construction as defined in this Act. | 12 | | "Department" means the Illinois Department of Labor.
| 13 | | Section 10. Apprenticeship program participation | 14 | | mandatory. As a condition of transacting business in this | 15 | | State, a contractor must document proof of participation in an | 16 | | apprenticeship program. | 17 | | Section 15. Enforcement. | 18 | | (a) It is the duty of the Department to conduct | 19 | | investigations related to any violations of this Act, institute | 20 | | the actions for penalties provided under this Act, and to | 21 | | enforce generally the provisions of this Act. | 22 | | (b) A contractor found to be in violation of this Act is | 23 | | subject to a civil penalty in an amount not exceeding $5,000 | 24 | | for a first violation and a penalty in an amount not exceeding |

| 1 | | $10,000 for each subsequent violation. | 2 | | (c) In the enforcement of this Act, the Department has the | 3 | | powers granted to it under the Illinois Wage Payment and | 4 | | Collection Act.
| 5 | | Section 20. Rules. The Department may adopt any rules | 6 | | necessary to implement this Act.
