| 1 | | AN ACT concerning State government.
| 2 | | Be it enacted by the People of the State of Illinois, | 3 | | represented in the General Assembly:
| 4 | | Section 5. The University of Illinois Trustees Act is | 5 | | amended by changing Section 1 as follows:
| 6 | | (110 ILCS 310/1) (from Ch. 144, par. 41)
| 7 | | Sec. 1.
The Board of Trustees of the University of Illinois | 8 | | shall consist
of the Governor and at least 12 trustees. Nine | 9 | | trustees shall be
appointed by the Governor, by and with the | 10 | | advice and consent of
the Senate. The other trustees shall be | 11 | | students, of whom one student shall
be selected from each | 12 | | University campus.
| 13 | | Each student trustee shall serve a term of one year, | 14 | | beginning on July 1 or
on the date of his or her selection, | 15 | | whichever is later, and expiring on the
next succeeding June | 16 | | 30.
| 17 | | Each trustee shall have all of the privileges of | 18 | | membership, except that only
one student trustee shall have the | 19 | | right to cast a legally binding vote. The
Governor shall | 20 | | designate which one of the student trustees shall possess, for
| 21 | | his or her entire term, the right to cast a legally binding | 22 | | vote. Each student
trustee who does not possess the right to | 23 | | cast a legally binding vote shall
have the right to cast an |

| 1 | | advisory vote and the right to make and second
motions and to | 2 | | attend executive sessions.
| 3 | | Each trustee shall be governed by the same conflict of | 4 | | interest standards.
Pursuant to those standards, it shall not | 5 | | be a conflict of interest for a
student trustee to vote on | 6 | | matters pertaining to students generally, such as
tuition and | 7 | | fees. However, it shall be a conflict of interest for a student
| 8 | | trustee to vote on
faculty member
tenure or promotion. For the | 9 | | purposes of this Section, a student member shall not be deemed | 10 | | to have a direct conflict of interest in and may vote on any | 11 | | item involving the employment or compensation of the Chancellor | 12 | | at any campus or the President of the University or the | 13 | | election of officers.
Student trustees shall be chosen by | 14 | | campus-wide
student election, and the
student trustee | 15 | | designated by the Governor to
possess a legally binding vote | 16 | | shall be
one of the students selected by this method. A student | 17 | | trustee who does not
possess a legally binding vote on a
| 18 | | measure at a meeting of the
Board or any of its committees | 19 | | shall not be considered a trustee
for the purpose
of | 20 | | determining whether a quorum is present at the time that | 21 | | measure is voted
upon. To be eligible for selection as a
| 22 | | student trustee
and
to be eligible to remain as a voting or | 23 | | nonvoting student trustee,
a student trustee must be a resident | 24 | | of this State,
must have and maintain a
grade point average | 25 | | that is equivalent to at least 2.5 on a 4.0 scale, and must
be a | 26 | | full time student enrolled at all times during his or her term |

except
for that part of the term which follows
the | 2 | | completion of the last full regular semester of an academic | 3 | | year and
precedes the first full regular semester of the | 4 | | succeeding academic year at the
University (sometimes commonly | 5 | | referred to as the summer
session or summer
school). If a | 6 | | voting or nonvoting student trustee
fails to
continue to meet | 7 | | or maintain the residency, minimum grade point average, or
| 8 | | enrollment requirement established by this Section, his
or her | 9 | | membership on the Board shall be deemed to have terminated by | 10 | | operation
of law. The University may not use residency for | 11 | | tuition purposes as a factor in making the determination that a | 12 | | student is or is not a resident of this State. The following | 13 | | factors shall positively demonstrate residency in this State | 14 | | for the purposes of the residency requirement for student | 15 | | trustees and candidates for student trustee:
| 16 | | (1) evidence of the student's Illinois domicile for at | 17 | | least the previous 6 months; | 18 | | (2) evidence of the student's current, valid Illinois | 19 | | driver's license; and | 20 | | (3) evidence of the student's valid Illinois voter | 21 | | registration. | 22 | | A positive demonstration of residency in this State for student | 23 | | trustees and candidates for student trustees under this Section | 24 | | does not apply to residency requirements for tuition purposes. | 25 | | If a voting student trustee resigns or otherwise ceases to | 26 | | serve on the
Board, the Governor shall, within 30 days, |

| 1 | | designate one of the remaining
student trustees to possess the | 2 | | right to cast a legally binding vote
for the remainder of his | 3 | | or her term. If a nonvoting student trustee resigns
or
| 4 | | otherwise ceases to serve on the Board, the chief executive of | 5 | | the
student government from that campus shall, within 30 days, | 6 | | select
a new nonvoting student trustee to serve for the | 7 | | remainder of the term.
| 8 | | No more than 5 of the 9 appointed trustees
shall be | 9 | | affiliated
with the same political party.
Each trustee | 10 | | appointed by the Governor must be a resident of this State. A
| 11 | | failure to meet
or maintain this residency requirement | 12 | | constitutes a resignation from and
creates a
vacancy in the | 13 | | Board.
The term of office of each appointed trustee
shall be 6 | 14 | | years from the third Monday in January of each odd numbered | 15 | | year.
The regular terms of office of the
appointed trustees | 16 | | shall be staggered so that 3 terms expire in each
odd-numbered | 17 | | year.
| 18 | | Vacancies for appointed trustees shall be filled for the | 19 | | unexpired term
in the same manner as
original appointments. If | 20 | | a vacancy in membership occurs at a time when the
Senate is not | 21 | | in session, the Governor shall make temporary appointments | 22 | | until
the next meeting of the Senate, when he shall appoint | 23 | | persons to fill such
memberships for the remainder of their | 24 | | respective terms. If the Senate is not
in session when | 25 | | appointments for a full term are made, appointments shall be
| 26 | | made as in the case of vacancies.

| 1 | | No action of the board shall be invalidated by reason of | 2 | | any vacancies on
the board, or by reason of any failure to | 3 | | select student trustees.

| 5 | | Section 10. The Southern Illinois University Management | 6 | | Act is amended by changing Section 5 as follows:

Members of the Board shall elect annually by secret | 9 | | ballot from
their own number a chairman who shall preside over | 10 | | meetings of the Board and
a secretary.
| 11 | | Meetings of the Board shall be held at least once each | 12 | | quarter on a campus
of Southern Illinois University. At all | 13 | | regular meetings of the Board, a
majority of its voting members | 14 | | shall constitute a quorum. The student members
shall have all | 15 | | of the privileges of membership, including the right to make | 16 | | and
second motions and to attend executive sessions, other than | 17 | | the right to vote,
except that the student member designated
by | 18 | | the Governor as the voting student member shall have the right | 19 | | to vote on
all Board matters except those involving faculty | 20 | | tenure, faculty promotion or
any issue on which the student | 21 | | member has a direct conflict of interest. For the purposes of | 22 | | this Section, a student member shall not be deemed to have a | 23 | | direct conflict of interest in and may vote on any item | 24 | | involving the employment or compensation of the Chancellor at |

of Western Illinois University at | 16 | | Macomb, Illinois. At all regular meetings of
the Board, a | 17 | | majority of its members shall constitute a quorum. The student
| 18 | | member shall have all of the privileges of membership, | 19 | | including the right to
make and second motions, to attend | 20 | | executive sessions, and to vote on all Board
matters except | 21 | | those involving faculty tenure, faculty promotion or any issue
