Amends the Election Code. Provides that at the time a candidate for President or Vice President of the United States files a statement of candidacy, the State Board of Elections shall give the candidate a blank form of the Code of Fair Campaign Practices and a copy of its provisions. Effective immediately.

| 1 | | AN ACT concerning elections.
| 2 | | Be it enacted by the People of the State of Illinois,
| 3 | | represented in the General Assembly:
| 4 | | Section 5. The Election Code is amended by changing Section | 5 | | 29B-10 as follows:
| 6 | | (10 ILCS 5/29B-10) (from Ch. 46, par. 29B-10; formerly Ch. | 7 | | 46, par. 1103)
| 8 | | Sec. 29B-10. Code of Fair Campaign Practices. At the time a
| 9 | | political committee, as defined in Article 9, files its
| 10 | | statements of organization, or at the time a candidate for | 11 | | President or Vice President of the United States files a | 12 | | statement of candidacy under Section 7-11 of this Code, the | 13 | | State Board of Elections, in the case of a candidate for the | 14 | | President or Vice President of the United States, a
state | 15 | | political committee , or a political committee acting as both a | 16 | | state
political committee and a local political committee, or | 17 | | the county clerk,
in the case of a local political committee, | 18 | | shall give the candidate or political
committee a blank form of | 19 | | the Code of Fair Campaign Practices and a copy of
the | 20 | | provisions of this Article. The State Board of Elections or | 21 | | county clerk
shall inform each political committee that | 22 | | subscription to the Code is
voluntary. The text of the Code | 23 | | shall read as follows:

| 1 | | CODE OF FAIR CAMPAIGN PRACTICES
| 2 | | There are basic principles of decency, honesty, and fair | 3 | | play that every
candidate for public office in the State of | 4 | | Illinois has a moral obligation
to observe and uphold, in order | 5 | | that, after vigorously contested but fairly
conducted | 6 | | campaigns, our citizens may exercise their constitutional | 7 | | right
to a free and untrammeled choice and the will of the | 8 | | people may be fully
and clearly expressed on the issues.
| 9 | | THEREFORE:
| 10 | | (1) I will conduct my campaign openly and publicly, and | 11 | | limit attacks on
my opponent to legitimate challenges to his | 12 | | record.
| 13 | | (2) I will not use or permit the use of character | 14 | | defamation, whispering
campaigns, libel, slander, or | 15 | | scurrilous attacks on any candidate or his
personal or family | 16 | | life.
| 17 | | (3) I will not use or permit any appeal to negative | 18 | | prejudice based on
race, sex, sexual orientation, religion or | 19 | | national origin.
| 20 | | (4) I will not use campaign material of any sort that | 21 | | misrepresents,
distorts, or otherwise falsifies the facts, nor | 22 | | will I use
malicious or unfounded accusations that aim at | 23 | | creating or exploiting
doubts, without justification, as to the | 24 | | personal integrity or patriotism
of my opposition.
| 25 | | (5) I will not undertake or condone any dishonest or | 26 | | unethical practice
that tends to corrupt or undermine our |

| 1 | | American system of free elections
or that hampers or prevents | 2 | | the full and free expression of the will of
the voters.
| 3 | | (6) I will defend and uphold the right of every qualified | 4 | | American voter
to full and equal participation in the electoral | 5 | | process.
| 6 | | (7) I will immediately and publicly repudiate methods and | 7 | | tactics that
may come from others that I have pledged not to | 8 | | use or condone. I shall
take firm action against any | 9 | | subordinate who violates any provision of this
Code or the laws | 10 | | governing elections.
| 11 | | I, the undersigned, candidate for election to public office | 12 | | in the State
of Illinois or chair of a political committee in | 13 | | support of or
opposition to a question of public policy, hereby | 14 | | voluntarily endorse,
subscribe to, and solemnly pledge myself | 15 | | to conduct my campaign
in accordance with the above principles | 16 | | and practices.
