Amends the Wildlife Code. Provides that it shall be unlawful for any person to trap or to hunt with gun, dog, dog and gun, or bow and arrow, gray fox, red fox, raccoon, weasel, mink, muskrat, badger, bobcat, and opossum except during the open season which will be set annually by the Director to start between 12:01 a.m., November 1 and 12:00 midnight on November 10, and close no earlier than 12:00 midnight on February 15 but not later than 12:00 midnight on March 31, with start and close dates both inclusive (rather than between 12:01 a.m., November 1 to 12:00 midnight February 15, both inclusive). Deletes a provision providing that the season limit for river otter shall not exceed 5 river otters per person per season. Provides that any person who violates the provisions of the Section, including administrative rules, shall be guilty of a Class B misdemeanor.

| 2 | | Be it enacted by the People of the State of Illinois,
| 3 | | represented in the General Assembly:
| 4 | | Section 5. The Wildlife Code is amended by changing Section | 5 | | 2.30 as follows:
| 6 | | (520 ILCS 5/2.30) (from Ch. 61, par. 2.30)
| 7 | | Sec. 2.30. | 8 | | (a) It shall be unlawful for any person to trap or to hunt
| 9 | | with gun, dog, dog and gun, or bow and arrow, gray fox, red | 10 | | fox,
raccoon, weasel, mink, muskrat, badger, bobcat, and | 11 | | opossum except during
the open season which will be set | 12 | | annually by the Director to start between 12:01
a.m., November | 13 | | 1 and 12:00 midnight on November 10, and close no earlier than | 14 | | 12:00 midnight on to 12:00 midnight, February 15 but not later | 15 | | than 12:00 midnight on March 31 , with start and close dates | 16 | | both inclusive , except as provided in subsections (e) and (f) | 17 | | of this Section .

between the hours of sunset and sunrise during the | 20 | | 10 day period
preceding the opening date of the raccoon hunting | 21 | | season and the 10 day
period following the closing date of the | 22 | | raccoon hunting season except
that the Department may issue | 23 | | field trial permits in accordance with Section
2.34 of this |

| 1 | | Act. A non-resident from a state with more restrictive
| 2 | | fur-bearer pursuit regulations for any particular species than | 3 | | provided for
that species in this Act may not pursue that | 4 | | species in Illinois except
during the period of time that | 5 | | Illinois residents are allowed to pursue
that species in the | 6 | | non-resident's state of residence. Hound running areas | 7 | | approved by the Department shall be exempt from the
provisions | 8 | | of this Section.
| 9 | | (c) It shall be unlawful to take beaver, river otter, | 10 | | weasel, mink, or muskrat except during
the open season set | 11 | | annually by the Director, and then, only with traps, except | 12 | | that a firearm, pistol, or airgun of a caliber not larger than | 13 | | a .22 long rifle may be used to remove the animal from the | 14 | | trap.
| 15 | | (d) It shall be unlawful for any person to trap beaver or | 16 | | river otter with traps except during
the open season which will | 17 | | be set annually by the Director between 12:01
a.m., November | 18 | | 1st and 12:00 midnight, March 31, both inclusive.
| 19 | | (e) Coyote may be taken by trapping methods only during the | 20 | | period from
September 1 to March 31 1 , both inclusive, and by | 21 | | hunting methods at any time.
| 22 | | (f) Striped skunk may be taken by trapping methods only | 23 | | during the period
from September 1 to March 31 1 , both | 24 | | inclusive, and by hunting methods at
any time.
| 25 | | (g) Muskrat may be taken by trapping methods during an open | 26 | | season set annually by the Director. |

| 1 | | (h) For the purpose of taking fur-bearing mammals, the | 2 | | State may be
divided into management zones by administrative | 3 | | rule.
| 4 | | (i) It shall be unlawful to take or possess more than the | 5 | | season limit or possession limit of fur-bearing mammals that | 6 | | shall be set annually by the Director. The season limit for | 7 | | river otter shall not exceed 5 river otters per person per | 8 | | season. The season limit for bobcat shall not exceed one bobcat | 9 | | per permit. Possession limits shall not apply to fur buyers, | 10 | | tanners, manufacturers, and taxidermists, as defined by this | 11 | | Act, who possess fur-bearing mammals in accordance with laws | 12 | | governing such activities. | 13 | | (j) Nothing in this Section shall prohibit the taking or | 14 | | possessing of fur-bearing mammals found dead or | 15 | | unintentionally killed by a vehicle along a roadway during the | 16 | | open season provided the person who possesses such fur-bearing | 17 | | mammals has all appropriate licenses, stamps, or permits; the | 18 | | season for which the species possessed is open; and that such | 19 | | possession and disposal of such fur-bearing mammals is | 20 | | otherwise subject to the provisions of this Section. | 21 | | (k) The provisions of this Section are subject to | 22 | | modification by administrative rule , except subsections (a), | 23 | | (e), and (f) of this Section . | 24 | | (l) Any person who violates the provisions of this Section, | 25 | | including administrative rules, shall be guilty of a Class B | 26 | | misdemeanor. |
