Amends the Illinois Lottery Law. Allows the Department of the Lottery to offer interactive instant win games through the Internet program. Requires the private manager to obtain the Director of the Lottery's approval before commencing the interactive instant win games program. Defines "interactive instant win game". Effective immediately.

| 2 | | Be it enacted by the People of the State of Illinois,
| 3 | | represented in the General Assembly:
| 4 | | Section 5. The Illinois Lottery Law is amended by changing | 5 | | Section 7.12 as follows: | 6 | | (20 ILCS 1605/7.12) | 7 | | (Section scheduled to be repealed on July 1, 2022) | 8 | | Sec. 7.12. Internet program. | 9 | | (a) The General Assembly finds that: | 10 | | (1) the consumer market in Illinois has changed since | 11 | | the creation of the Illinois State Lottery in 1974; | 12 | | (2) the Internet has become an integral part of | 13 | | everyday life for a significant number of Illinois | 14 | | residents not only in regards to their professional life, | 15 | | but also in regards to personal business and | 16 | | communication; and | 17 | | (3) the current practices of selling lottery tickets | 18 | | does not appeal to the new form of market participants who | 19 | | prefer to make purchases on the Internet at their own | 20 | | convenience. | 21 | | It is the intent of the General Assembly to create an | 22 | | Internet program for the sale of lottery tickets to capture | 23 | | this new form of market participant. |

| 1 | | (b) The Department shall create a program that allows an | 2 | | individual 18 years of age or older to purchase lottery | 3 | | tickets or shares on the Internet without using a Lottery | 4 | | retailer with on-line status, as those terms are defined by | 5 | | rule. The Department shall restrict the sale of lottery | 6 | | tickets on the Internet to transactions initiated and received | 7 | | or otherwise made exclusively within the State of Illinois. | 8 | | The Department shall adopt rules necessary for the | 9 | | administration of this program. These rules shall include, | 10 | | among other things, requirements for marketing of the Lottery | 11 | | to infrequent players, as well as limitations on the purchases | 12 | | that may be made through any one individual's lottery account. | 13 | | The provisions of this Act and the rules adopted under this Act | 14 | | shall apply to the sale of lottery tickets or shares under this | 15 | | program. | 16 | | The Department is obligated to implement the program set | 17 | | forth in this Section and Sections 7.15 and 7.16. The | 18 | | Department may offer Lotto, Lucky Day Lotto, Mega Millions, | 19 | | Powerball, Pick 3, Pick 4, and other draw games that are | 20 | | offered at retail locations , as well as interactive instant | 21 | | win games, through the Internet program. The private manager | 22 | | shall obtain the Director's approval before providing any draw | 23 | | games or commencing the interactive instant win games program. | 24 | | The Department shall make interactive instant win games | 25 | | available for sale exclusively at retail locations by lottery | 26 | | licensees pursuant to the Department's rules for 6 months |

| 1 | | following the initial launch date to enhance the Department's | 2 | | revenue growth from retail sales. Thereafter, the Department | 3 | | shall concurrently offer interactive instant win games over | 4 | | the Internet and in retail locations. The Department shall not | 5 | | offer any interactive instant win game that qualifies as a | 6 | | "gambling game", as that term is defined in Section 4 of the | 7 | | Illinois Gambling Act. As used in this Section, "interactive | 8 | | instant win game" means a virtual Lottery instant game with | 9 | | specified prize structures and set odds that does not include | 10 | | an instant-reveal function that immediately reveals the | 11 | | outcome of the game . Any draw game tickets that are approved | 12 | | for sale by lottery licensees are automatically approved for | 13 | | sale through the Internet program. The Department shall | 14 | | maintain responsible gaming controls in its policies. | 15 | | The Department shall authorize the private manager to | 16 | | implement and administer the program pursuant to the | 17 | | management agreement entered into under Section 9.1 and in a | 18 | | manner consistent with the provisions of this Section. If a | 19 | | private manager has not been selected pursuant to Section 9.1 | 20 | | at the time the Department is obligated to implement the | 21 | | program, then the Department shall not proceed with the | 22 | | program until after the selection of the private manager, at | 23 | | which time the Department shall authorize the private manager | 24 | | to implement and administer the program pursuant to the | 25 | | management agreement entered into under Section 9.1 and in a | 26 | | manner consistent with the provisions of this Section. |

| 1 | | Nothing in this Section shall be construed as prohibiting | 2 | | the Department from implementing and operating a website | 3 | | portal whereby individuals who are 18 years of age or older | 4 | | with an Illinois mailing address may apply to purchase lottery | 5 | | tickets via subscription. Nothing in this Section shall also | 6 | | be construed as prohibiting the Lottery draw game tickets or | 7 | | interactive instant win games authorized for sale through the | 8 | | Internet program under this Section from also continuing to be | 9 | | sold at retail locations by a lottery licensee pursuant to the | 10 | | Department's rules. | 11 | | (c) (Blank). | 12 | | (d) This Section is repealed on July 1, 2022. | 13 | | (Source: P.A. 100-23, eff. 7-6-17; 100-587, eff. 6-4-18; | 14 | | 101-35, eff. 6-28-19.)
