1    AN ACT concerning safety.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Environmental Protection Act is amended by
5adding Section 22.56 as follows:
 
6    (415 ILCS 5/22.56 new)
7    Sec. 22.56. Regulation of farm land sludge application.
8    (a) Any person applying sludge, as defined in Section 3.465
9of this Act, to agricultural farm land in this State must:
10        (1) provide, no sooner than 90 days and no later than 7
11    days before the application of the sludge to the land in
12    question, written notice to the owners of the land upon
13    which the sludge is to be applied, the owners of land that
14    is adjacent to the land upon which the sludge is to be
15    applied, and the township and county officials whose
16    jurisdiction encompasses the land upon which the sludge is
17    to be applied;
18        (2) not stockpile sludge, except for lime sludge, which
19    is defined as any solid, semi-solid, or liquid waste
20    generated from a municipal, commercial, or industrial
21    water treatment plant using the lime softening treatment
22    process, and lime-alum sludge, at the same site for a
23    period of more than 30 days between applications of sludge;

1        (3) not apply the sludge in trenches that are deeper
2    than the rooting depth of the crop, unless the sludge is
3    applied at rates that do not exceed the agronomic rate, as
4    defined and calculated under 35 Ill. Adm. Code 391;
5        (4) not apply sludge closer than 100 feet to an
6    occupied dwelling; and
7        (5) make available to any requesting party, for up to 5
8    years after the application of the sludge, any
9    documentation of sludge analysis for parameters required
10    under 40 CFR 503 or 35 Ill. Adm. Code 391.
11    (b) The requirements contained in this Section shall be in
12addition to any permit requirements otherwise imposed by the
13Agency. Nothing in this Section shall be interpreted to
14restrict, or in any way limit, the application of sludge on
15land (i) owned by a unit of local government or (ii) used for
16recreational purposes.
 
17    Section 99. Effective date. This Act takes effect upon
18becoming law.
