SYNOPSIS AS INTRODUCED:
 
ILCON Art. VI, Sec. 19

    Proposes to amend the Judiciary Article of the Illinois Constitution. Requires each State's Attorney to be a resident of the State. Effective upon being declared adopted in accordance with Section 7 of the Illinois Constitutional Amendment Act. Applies to the election of State's Attorneys in 2016 and thereafter; does not affect the terms of State's Attorneys elected before 2016.

CONSTITUTIONAL AMENDMENT

 
3    RESOLVED, BY THE SENATE OF THE NINETY-SEVENTH GENERAL
4ASSEMBLY OF THE STATE OF ILLINOIS, THE HOUSE OF REPRESENTATIVES
5CONCURRING HEREIN, that there shall be submitted to the
6electors of the State for adoption or rejection at the general
7election next occurring at least 6 months after the adoption of
8this resolution a proposition to amend Section 19 of Article VI
9of the Illinois Constitution as follows:

THE JUDICIARY

13SECTION 19. STATE'S ATTORNEYS - SELECTION, SALARY
14    A State's Attorney shall be elected in each county in 1972
15and every fourth year thereafter for a four year term. One
16State's Attorney may be elected to serve two or more counties
17if the governing boards of such counties so provide and a
18majority of the electors of each county voting on the issue
19approve. A person shall not be eligible for the office of
20State's Attorney unless he or she is a United States citizen,
21and a licensed attorney-at-law of this State, and a resident of
22this State. His or her salary shall be provided by law.

SCHEDULE
2    This Constitutional Amendment takes effect upon being
3declared adopted in accordance with Section 7 of the Illinois
4Constitutional Amendment Act and applies to the election of
5State's Attorneys in 2016 and thereafter. It does not affect
6the terms of State's Attorneys elected before 2016.
