Creates the Statewide Relocation Towing Licensure Commission Act of 2019. Creates the Statewide Relocation Towing Licensure Commission. Provides membership and meeting requirements for the Commission. Provides that the Commission shall submit a report to the Governor no later than December 31, 2020. Provides that the report shall include, but is not limited to: (1) an evaluation of the current towing laws in this State; (2) a recommendation for an appropriate towing licensure program for this State; (3) a review of all potential litigation costs for an owner of an impounded vehicle, a towing company, and a county or municipality; and (4) any other matters the Commission deems necessary. Repeals the Act on January 1, 2022. Effective immediately.

| 2 | | Be it enacted by the People of the State of Illinois,
| 3 | | represented in the General Assembly:
| 4 | | Section 1. Short title. This Act may be cited as the | 5 | | Statewide Relocation Towing Licensure Commission Act of 2019. | 6 | | Section 5. The Statewide Relocation Towing Licensure | 7 | | Commission. | 8 | | (a) The Statewide Relocation Towing Licensure Commission | 9 | | is created. | 10 | | (b) Within 60 days after the effective date of this Act, | 11 | | the members of the Commission shall be appointed with the | 12 | | following members: | 13 | | (1) one member of the General Assembly, appointed by | 14 | | the President of the Senate; | 15 | | (2) one member of the General Assembly, appointed by | 16 | | the Minority Leader of the Senate; | 17 | | (3) one member of the General Assembly, appointed by | 18 | | the Speaker of the House of Representatives; | 19 | | (4) one member of the General Assembly, appointed by | 20 | | the Minority Leader of the House of Representatives; | 21 | | (5) the Mayor of the City of Chicago, or his or her | 22 | | designee; | 23 | | (6) the Secretary of Transportation, or his or her |

| 1 | | designee; | 2 | | (7) the Director of State Police, or his or her | 3 | | designee; | 4 | | (8) 2 members of the public who represent the towing | 5 | | industry, appointed by the President of the Professional | 6 | | Towing and Recovery Operators of Illinois; | 7 | | (9) 2 members of the public who represent the property | 8 | | casualty insurance industry, appointed by the Executive | 9 | | Director of the Illinois Insurance Association; | 10 | | (10) the President of the Illinois Municipal League, or | 11 | | his or her designee; | 12 | | (11) the President of the Illinois Sheriffs' | 13 | | Association, or his or her designee; | 14 | | (12) the Cook County State's Attorney, or his or her | 15 | | designee; | 16 | | (13) the Chairman of the Illinois Commerce Commission, | 17 | | or his or her designee; and | 18 | | (14) the President of the Northwest Municipal | 19 | | Conference, or his or her designee. | 20 | | (c) The members of the Commission shall receive no | 21 | | compensation for serving as members of the Commission. | 22 | | (d) The Illinois Commerce Commission shall provide | 23 | | administrative and other support to the Commission. | 24 | | Section 10. Meetings. | 25 | | (a) Each member of the Commission shall have voting rights |

| 1 | | and all actions and recommendations shall be approved by a | 2 | | simple majority vote of the members. | 3 | | (b) The Commission shall meet no less than 3 times before | 4 | | the report described in Section 15 is filed. | 5 | | (c) At the initial meeting, the Commission shall elect one | 6 | | member as a Chairperson, through a simple majority vote, who | 7 | | shall thereafter call any subsequent meetings. | 8 | | Section 15. Reporting. No later than December 31, 2020, the | 9 | | Commission shall submit a report to the Governor and to the | 10 | | General Assembly that shall include, but is not limited to: | 11 | | (1) an evaluation of the current towing laws in this | 12 | | State; | 13 | | (2) a recommendation for an appropriate towing | 14 | | licensure program for this State; | 15 | | (3) a review of all potential litigation costs for an | 16 | | owner of an impounded vehicle, a towing company, and a | 17 | | county or municipality; and | 18 | | (4) any other matters the Commission deems necessary. | 19 | | Section 20. Repealer. This Act is repealed on January 1, | 20 | | 2022.
