1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Counties Code is amended by changing Section
53-5015 as follows:
 
6    (55 ILCS 5/3-5015)  (from Ch. 34, par. 3-5015)
7    Sec. 3-5015. Certificates of discharge or release from
8active duty. Certificates of discharge or MEMBER-4 copy of
9certificate of release or discharge from active duty of
10honorably discharged or separated members of the military,
11aviation and naval forces of the United States shall be
12recorded by each recorder, free of charge, in a separate book
13which shall be kept for the purpose. The recorder in counties
14of over 500,000 population shall as soon as practicable after
15the recording of the original discharge certificate or MEMBER-4
16copy of certificate of release or discharge from active duty,
17deliver to each of the persons named in the discharge
18certificate or MEMBER-4 copy of certificate of release or
19discharge from active duty, or his agent, one certified copy of
20his discharge certificate or MEMBER-4 copy of certificate of
21release or discharge from active duty without charge.
22Additional certified copies shall be furnished by the recorder
23upon the payment to the recorder of a fee of $1.25, payable in

1advance, for each such additional certified copy.
2    Upon the delivery of the certificate of discharge or
3MEMBER-4 copy of certificate of release or discharge from
4active duty after the recordation thereof is completed, and the
5delivery of one certified copy thereof to the person named in
6the discharge certificate or MEMBER-4 copy of certificate of
7release or discharge from active duty or his agent, the receipt
8theretofore issued by the recorder, or a copy thereof shall be
9surrendered to the recorder, with a signed statement
10acknowledging the receipt of the discharge certificate or
11MEMBER-4 copy of certificate of release or discharge from
12active duty and the certified copy thereof.
13    Certified copies of the certificates of discharge or
14MEMBER-4 copy of certificate of release or discharge from
15active duty furnished by the recorder may vary from the size of
16the original, if in the judgment of the recorder, such
17certified copies are complete and legible.
18    A military discharge form (DD-214) or any other certificate
19of discharge or release from active duty document that was
20issued by the United States government or any state government
21in reference to those who served with an active or inactive
22military reserve unit or National Guard force and that was
23recorded by a County Clerk or Recorder of Deeds is not subject
24to public inspection, enjoying all the protection covered by
25the federal Privacy Act of 1974 or any other privacy law. These
26documents shall be accessible only to the person named in the

1document, the named person's dependents, the county veterans'
2service officer, representatives of the Department of
3Veterans' Affairs, or any person with written authorization
4from the named person or the named person's dependents.
5Notwithstanding any other provision in this paragraph, these
6documents shall be made available for public inspection and
7copying in accordance with the archival schedule adopted by the
8National Archives and Records Administration and subject to
9redaction of information that is considered private under the
10Illinois Freedom of Information Act, the Federal Freedom of
11Information Act, and the Federal Privacy Act.

13    Section 99. Effective date. This Act takes effect upon
14becoming law.
