    Amends the Mosquito Abatement District Act. Provides that a county board or board of county commissioners may by ordinance transfer the duties of all mosquito abatement districts in the county to the county and dissolve those districts. Includes provisions relating to submittal of the proposition of dissolution to the voters by referendum and transfer of personnel, property, tax levy powers, and funds of districts to the county. Amends the Counties Code making conforming changes.

1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Counties Code is amended by adding Section
55-1186 as follows:
 
6    (55 ILCS 5/5-1186 new)
7    Sec. 5-1186. Dissolution of all mosquito abatement
8districts in the county. The county board or board of county
9commissioners may dissolve all mosquito abatement districts in
10the county as provided in Section 11.7 of the Mosquito
11Abatement District Act.
 
12    Section 10. The Mosquito Abatement District Act is amended
13by adding Section 11.7 as follows:
 
14    (70 ILCS 1005/11.7 new)
15    Sec. 11.7. Dissolution of all districts in a county.
16    (a) A county board or board of county commissioners may
17adopt an ordinance to transfer the duties of all mosquito
18abatement districts in the county to the county, including
19those formed under Section 30-170 of the Township Code, and
20dissolve those districts. If a ordinance dissolving all
21mosquito abatement districts has been adopted, the county board

1or board of county commissioners shall order the proposition
2submitted to the voters of each district being dissolved. The
3county clerk shall certify the proposition to the proper
4election officials. Notice shall be given and the election
5conducted in accordance with the general election law. The
6proposition shall be in substantially the following form:
7        Shall all mosquito abatement districts in (name of
8    county) be dissolved?
9The votes shall be recorded as "Yes" or "No".
10    (b) If a majority of all votes combined from all districts
11are in favor of dissolving all mosquito abatement districts in
12the county:
13        (1) All personnel of a district is transferred to the
14    county. The status and rights of such employees under any
15    applicable collective bargaining agreements or under any
16    pension, retirement, or annuity plan shall not be affected
17    by dissolution of a district under this Section.
18        (2) All district books, records, papers, documents,
19    property (real and personal), including, but not limited
20    to, material in electronic or magnetic format and necessary
21    computer hardware and software, contracts, causes of
22    action, and pending business pertaining to the powers,
23    duties, rights, and responsibilities are transferred to
24    the county.
25        (3) All district tax levy powers and district tax
26    revenue, remaining balances, and other funds available for

1    use by a district shall be transferred for use by the
2    county and shall be expended only for the original purposes
3    for which the levied taxes, balances, or funds were
4    designated.
