1    AN ACT concerning civil law.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois and Michigan Canal Development Act
5is amended by adding Section 14.1 as follows:
 
6    (615 ILCS 45/14.1 new)
7    Sec. 14.1. Exchange of property.
8    (a) Notwithstanding any other provision of law or
9restriction on the property, including, but not limited to,
10any State rights, easements, or conveyance and reversion
11clauses restricting sale, the Village of Lemont may exchange
12with a nongovernmental entity the Illinois and Michigan Canal
13lands that were purchased from the State for other real
14property of substantially equal or greater value, as
15determined by 2 MAI appraisals of the properties, and of
16substantially the same or greater suitability for
17recreational, park, and parking purposes without additional
18cost to the Village. However, the property being transferred
19to the Village must be continuous to other Illinois and
20Michigan Canal lands owned by the Village.
21    (b) Prior to an exchange under subsection (a) with a
22nongovernmental entity, the Village board shall hold a public
23hearing in order to consider the proposed exchange. Notice of

1such a meeting shall be published at least twice, with the
2first and last publication being at least 10 days apart, in a
3newspaper of general circulation within the Village.
4    (c) This Section applies only to the exchange of Parcel
5One owned by the Village for Parcel Two owned by a
6nongovernmental entity as follows:
 
7    PARCEL ONE:
 
8    THAT PART OF SECTION 20, TOWNSHIP 37 NORTH, RANGE 11 EAST
9    OF THE THIRD PRINCIPAL MERIDIAN, ALL IN COOK COUNTY,
10    ILLINOIS, DESCRIBED AS FOLLOWS:
 
11    BEGINNING AT THE INTERSECTION OF THE SOUTH LINE OF THE
12    SOUTHERLY 90 FOOT RESERVE STRIP OF THE ILLINOIS AND
13    MICHIGAN CANAL AND THE NORTHEAST CORNER OF LOT 1 IN BLOCK 1
14    IN THE PLAT OF THE VILLAGE OF LEMONT, RECORDED AUGUST 8,
15    1874 AS DOCUMENT 184242; THENCE ALONG A LINE 141 FEET
16    SOUTHWESTERLY ALONG THE SOUTH LINE OF THE SOUTHERLY 90
17    FOOT RESERVE STRIP OF THE ILLINOIS AND MICHIGAN CANAL;
18    THENCE ALONG A LINE 79 FEET NORTHWESTERLY (AS MEASURED AT
19    RIGHT ANGLES THERETO) AND PARALLEL WITH THE EASTERLY LINE
20    OF BLOCK 1 IN SAID VILLAGE OF LEMONT SUBDIVISION, EXTENDED
21    NORTHWESTERLY; THENCE ALONG A LINE 139 FEET PARALLEL WITH
22    CANAL STREET; THENCE ALONG A LINE 63 FEET SOUTHEASTERLY TO
23    THE POINT OF BEGINNING, ALL IN COOK COUNTY, ILLINOIS.

2    THAT PART OF SECTION 20, TOWNSHIP 37 NORTH, RANGE 11 EAST

5    LOTS 8, 9, 10, 11, 12, 13, 14, 15, 16, 17, 18, 19, AND THAT
6    PART OF LOT 20 LYING EAST OF THE LEMONT ROAD BRIDGE, ALL IN
7    BLOCK 1 IN THE PLAT OF THE VILLAGE OF LEMONT, RECORDED
8    AUGUST 8, 1874 AS DOCUMENT 184242; ALL IN COOK COUNTY,
9    ILLINOIS.
