1    AN ACT concerning transportation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Vehicle Code is amended by adding
5Section 5-401.5 as follows:
 
6    (625 ILCS 5/5-401.5 new)
7    Sec. 5-401.5. Purchase of catalytic converters.
8    (a) A scrap processor or automotive parts recycler shall
9not purchase or receive a catalytic converter except from a
10commercial seller or from the individual who is the owner of
11the vehicle from which the catalytic converter was removed.
12The scrap processor or automotive parts recycler shall produce
13a record of the transaction that includes:
14        (1) the signature of the business or individual with
15    whom the business conducts the transaction;
16        (2) the time, date, location, and monetary amount or
17    other value of the transaction;
18        (3) the name of the employee who conducts the
19    transaction on behalf of the scrap processor or automotive
20    parts recycler;
21        (4) the name and telephone number of the individual
22    with whom the scrap processor or automotive parts recycler
23    conducts the transaction and a street address or a post

1    office box, if a post office box is listed on the
2    government issued photo identification;
3        (5) the make, model year, and the license plate number
4    and state of issue of the motor vehicle or motor vehicles,
5    if any, used to transport the individual who conducts the
6    transaction and to transport the catalytic converter that
7    is the subject of the transaction;
8        (6) a photocopy of a current, valid driver's license
9    or other government-issued photo identification belonging
10    to the individual with whom the scrap metal business
11    conducts the transaction;
12        (7) a photograph of, or video surveillance recording
13    depicting, a recognizable facial image of the individual
14    with whom the scrap metal business conducts the
15    transaction;
16        (8) a general description of the catalytic converter.
17    The description must include any identifiable marks on the
18    converter, if readily discernible, and must specify the
19    weight, quantity, or volume of the catalytic converter;
20    and
21        (9) the vehicle identification number or a copy of the
22    certificate of title for the vehicle from which the
23    catalytic converter was removed.
24    (b) In addition to any other penalty provided by law, the
25Secretary of State may impose on a scrap processor or
26automotive parts recycler a civil penalty not to exceed $1,000

1per violation if the business:
2        (1) acquires a catalytic converter without obtaining a
3    certificate of title of the vehicle from which the
4    catalytic converter was removed; or
5        (2) acquires a catalytic converter, or a component of
6    a catalytic converter, that has been removed from a
7    vehicle and is offered for sale as an independent item,
8    separate and distinct from a vehicle acquisition, whether
9    individually or as part of a bundle, bale, or other bulk
10    form.
