SYNOPSIS AS INTRODUCED:
 
720 ILCS 5/24-1.9 new

    Amends the Criminal Code of 2012. Provides that a person who is subject to an order of protection, an emergency order of protection, or an interim 30-day order of protection may not purchase or transport any firearm while the order is in effect. Provides that a person who is the subject of an emergency order of protection may not transport or possess a firearm while in the residence of the alleged victim while the order is in effect. Provides that a violation is a Class A misdemeanor.

1    AN ACT concerning criminal law.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Criminal Code of 2012 is amended by adding
5Section 24-1.9 as follows:
 
6    (720 ILCS 5/24-1.9 new)
7    Sec. 24-1.9. Purchase or transportation of firearm by
8persons subject to protective orders; penalty.
9    (a) A person who is subject to any of the following orders
10may not purchase or transport a firearm while the order is in
11effect:
12        (1) an order of protection entered under Section
13    112A-14 of the Code of Criminal Procedure of 1963 or under
14    Section 214 of the Illinois Domestic Violence Act of 1986;
15        (2) an emergency order of protection issued under
16    Section 112A-17 of the Code of Criminal Procedure of 1963
17    or under Section 217 of the Illinois Domestic Violence Act
18    of 1986;
19        (3) a 30-day interim order of protection issued under
20    Section 112A-18 of the Code of Criminal Procedure of 1963
21    or under Section 218 of the Illinois Domestic Violence Act
22    of 1986; or
23        (4) an order issued by a tribunal of another state, the

1    United States or any of its territories, possessions or
2    commonwealths, or the District of Columbia under a statute
3    that is substantially similar to those cited in paragraphs
4    (1), (2), or (3) of this subsection (a).
5    (b) A person who is the subject of an emergency order of
6protection may not transport or possess a firearm while in the
7residence of the alleged victim while the order is in effect.
8    (c) Sentence. A violation of this Section is a Class A
9misdemeanor.
