1     AN ACT concerning long-term care.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Nursing Home Care Act is amended by changing
5 Section 2-201.5 as follows:
 
6     (210 ILCS 45/2-201.5)
7     Sec. 2-201.5. Screening prior to nursing facility
8 admission.
9     (a) All persons age 18 or older seeking admission to a
10 nursing facility must be screened to determine the need for
11 nursing facility services prior to being admitted, regardless
12 of income, assets, or funding source. The screening must
13 include consultation on other care options that may be
14 available. Exceptions to the prescreening requirement, such as
15 emergency placements, may be defined by administrative rule. In
16 addition, any person who seeks to become eligible for medical
17 assistance from the Medical Assistance Program under the
18 Illinois Public Aid Code to pay for long term care services
19 while residing in a facility must be screened prior to
20 receiving those benefits. Screening for nursing facility
21 services shall be administered through procedures established
22 by administrative rule. Screening may be done by agencies other
23 than the Department as established by administrative rule. This
24 Section applies on and after July 1, 1996.
25     (b) Preadmission screening must be provided (i) by the
26 Department on Aging for persons age 60 or older, (ii) by the
27 Department of Human Services for persons with developmental
28 disabilities or mental illness, regardless of their age, and
29 for persons under age 60, and (iii) by the Department of Public
30 Aid in the case of screenings conducted in connection with a
31 determination of eligibility for medical assistance under
32 Article V of the Illinois Public Aid Code. Each agency involved

1 in the screening process must coordinate prescreening
2 activities to ensure that persons are served in the most
3 integrated setting possible appropriate to their needs and have
4 the necessary information to make informed choices about care
5 options. In addition, each agency may also conduct periodic
6 follow-up screenings of persons who choose to be admitted to a
7 nursing facility, including screenings of nursing facility
8 residents who seek to become eligible for medical assistance
9 under Article V of the Illinois Public Aid Code, which may
10 assist in rebalancing the long-term care system.
