 1        AN ACT concerning dogs.

 2        Be it enacted by the People of  the  State  of  Illinois,
 3    represented in the General Assembly:

 4        Section  5.   The  Guide  Dog  Access  Act  is amended by
 5    changing Section 1 as follows:

 6        (720 ILCS 630/1) (from Ch. 38, par. 65-1)
 7        Sec. 1.  When a blind,  hearing  impaired  or  physically
 8    handicapped  person or a person who is subject to epilepsy or
 9    other seizure disorders is accompanied by a dog which  serves
10    as a guide, or leader, seizure-alert, or seizure-response dog
11    for  such  person  or  when  a trainer of a guide, or leader,
12    seizure-alert, or seizure-response  dog is accompanied  by  a
13    guide, or leader, seizure-alert, or seizure-response dog or a
14    dog  that  is  being  trained  to  be  a  guide,  or  leader,
15    seizure-alert,  or  seizure-response  dog, neither the person
16    nor the dog shall be denied the right of  entry  and  use  of
17    facilities of any public place of accommodation as defined in
18    Section 5-101 of the "Illinois Human Rights Act", if such dog
19    is wearing a harness and such person presents credentials for
20    inspection  issued  by  a  school for training guide, leader,
21    seizure-alert, or seizure-response dogs.
22        Any violation of this Act is a Class C misdemeanor.

24        Section 10.  The White Cane Law is  amended  by  changing
25    Section 3 as follows:

27        Sec. 3.  The blind, the visually handicapped, the hearing
28    impaired,  persons  who  are  subject  to  epilepsy  or other
29    seizure disorders, and the otherwise physically disabled have

 1    the same right as the able-bodied to the full and free use of
 2    the streets, highways, sidewalks, walkways, public buildings,
 3    public facilities and other public places.
 4        The  blind,  the  visually   handicapped,   the   hearing
 5    impaired,  persons  who  are  subject  to  epilepsy  or other
 6    seizure disorders, and the otherwise physically disabled  are
 7    entitled   to  full  and  equal  accommodations,  advantages,
 8    facilities and privileges of all common carriers,  airplanes,
 9    motor  vehicles,  railroad  trains, motor buses, street cars,
10    boats  or  any  other  public   conveyances   or   modes   of
11    transportation,  hotels,  lodging  places,  places  of public
12    accommodation, amusement or resort and other places to  which
13    the general public is invited, subject only to the conditions
14    and  limitations  established  by law and applicable alike to
15    all persons.
16        Every  totally  or  partially  blind,  hearing  impaired,
17    person who is subject to epilepsy or other seizure disorders,
18    or otherwise physically  disabled  person  or  a  trainer  of
19    support     dogs,    guide    dogs,    seizure-alert    dogs,
20    seizure-response dogs, or hearing dogs shall have  the  right
21    to  be  accompanied  by a support dog or guide dog especially
22    trained for the purpose, or a dog that is being trained to be
23    a support dog, guide dog, seizure-alert dog, seizure-response
24    dog, or hearing dog, in any of  the  places  listed  in  this
25    Section without being required to pay an extra charge for the
26    guide,  support,  seizure-alert, seizure-response, or hearing
27    dog; provided that he shall be liable for any damage done  to
28    the premises or facilities by such dog.
