SYNOPSIS AS INTRODUCED:

30 ILCS 605/7.6 new

Amends the State Property Control Act. Prohibits any State official, employee, or agent from granting naming or sponsorship rights, by any means, for State property to any entity with respect to advertising, promoting, or representing tobacco or tobacco related interests. Requires that any grant of naming or sponsorship rights must be reviewed and approved by the appropriate ethics commission. Effective immediately.

A BILL FOR

AN ACT concerning the preservation and integrity of historic and other State properties.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The State Property Control Act is amended by adding Section 7.6 as follows:

(30 ILCS 605/7.6 new)

Sec. 7.6. Naming and sponsorship rights.

(a) Naming rights and sponsorship rights regarding any property or asset of the State, whether real, personal, tangible, or intangible, may not be sold, conveyed, leased, licensed, or otherwise granted by the administrator or by any other official, employee, or agent of the State with respect to companies, businesses, or persons advertising, promoting, or otherwise representing tobacco or tobacco related interests including, but not limited to, cigarettes, cigars, and smokeless tobacco products.

(b) Any contract, lease, sale, conveyance, license, or other grant of rights to name or sponsor any property or asset of the State, whether real, personal, tangible, or intangible, must be reviewed and approved by majority vote of the appropriate ethics commission established by the State Officials and Employees Ethics Act (5 ILCS 430/).

(c) "Naming rights" under this Section means the right to associate the name or identifying mark of any person or entity with the name or identity of any State property or other asset.

(d) "Sponsorship rights" under this Section means the right to associate the name or identifying mark of any person or entity with any State program or event on the grounds of, in, or with respect to any State property or other asset.

Section 99. Effective date. This Act takes effect upon becoming law.
