    Amends the O'Hare Modernization Act. Makes a technical change in a Section concerning the acquisition of property.

1     AN ACT concerning transportation.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The O'Hare Modernization Act is amended by
5 changing Section 15 as follows:
 
6     (620 ILCS 65/15)
7     Sec. 15. Acquisition of property. In addition to any other
8 powers the the City may have, and notwithstanding any other law
9 to the contrary, the City may acquire by gift, grant, lease,
10 purchase, condemnation (including condemnation by quick take
11 under Section 7-103.149 of the Code of Civil Procedure), or
12 otherwise any right, title, or interest in any private
13 property, property held in the name of or belonging to any
14 public body or unit of government, or any property devoted to a
15 public use, or any other rights or easements, including any
16 property, rights, or easements owned by the State, units of
17 local government, or school districts, including forest
18 preserve districts, for purposes related to the O'Hare
19 Modernization Program. The powers given to the City under this
20 Section include the power to acquire, by condemnation or
21 otherwise, any property used for cemetery purposes within or
22 outside of the City, and to require that the cemetery be
23 removed to a different location. The powers given to the City
24 under this Section include the power to condemn or otherwise
25 acquire (other than by condemnation by quick take under Section
26 7-103 of the Code of Civil Procedure), and to convey,
27 substitute property when the City reasonably determines that
28 monetary compensation will not be sufficient or practical just
29 compensation for property acquired by the City in connection
30 with the O'Hare Modernization Program. The acquisition of
31 substitute property is declared to be for public use. Property
32 acquired under this Section includes property that the City

1 reasonably determines will be necessary for future use,
2 regardless of whether final regulatory or funding decisions
3 have been made; provided, however, that quick-take of such
4 property is subject to Section 7-103.149 of the Code of Civil
5 Procedure.
