SYNOPSIS AS INTRODUCED:
 
40 ILCS 5/11-182   from Ch. 108 1/2, par. 11-182

    Amends the Chicago Laborer Article of the Illinois Pension Code. Provides that any current employee member of the board who is serving in a position exempt from the classified service or the personnel ordinance of a city that has adopted a career service ordinance remains eligible to serve on and be re-elected to the board if he or she is on leave of absence from a position that is not exempt from that classified service or personnel ordinance. Effective immediately.

1     AN ACT concerning public employee benefits.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Illinois Pension Code is amended by changing
5 Section 11-182 as follows:
 
6     (40 ILCS 5/11-182)  (from Ch. 108 1/2, par. 11-182)
7     Sec. 11-182. Board elections; qualification; oath.
8     (a) In each year, the board shall conduct a regular
9 election, under rules adopted by it, at least 30 days prior to
10 the expiration of the term of the employee member whose term
11 next expires, for the election of a successor for a term of 3
12 years.
13     Each employee member and his or her successor shall be an
14 employee who holds a position by certification and appointment
15 as a result of competitive civil service examination as
16 distinguished from temporary appointment, or so holds a
17 position which is not exempt from the classified service or the
18 personnel ordinance of a city that has adopted a career service
19 ordinance, for a period of not less than 5 years prior to date
20 of election. However, any current employee member of the board
21 who is serving in a position exempt from the classified service
22 or the personnel ordinance of a city that has adopted a career
23 service ordinance remains eligible to serve on and be

1 re-elected to the board if he or she is on leave of absence
2 from a position that is not exempt from that classified service
3 or personnel ordinance.
4     At any such election, all persons who are employees at the
5 time such election is held shall have a right to vote. The
6 ballot shall be of secret character.
7     (b) The board shall conduct a regular election, under rules
8 adopted by it, at least 30 days prior to the expiration of the
9 term of the annuitant member, for the election of a successor
10 for a term of 3 years. Each annuitant member and his or her
11 successor shall be a former employee receiving a retirement
12 (age and service or prior service) annuity from the Fund. At
13 any such election, all persons who are receiving a retirement
14 (age and service or prior service) annuity from the Fund at the
15 time the election is held have a right to vote. The ballot
16 shall be of secret character.
17     (c) Any appointive or elective member of the board shall
18 hold office until his or her successor is elected and
19 qualified.
20     Any person elected or appointed as a member of the board
21 shall qualify for the office by taking an oath of office to be
22 administered by the city clerk or any person designated by the
23 city clerk. A copy thereof shall be kept in the office of the
24 city clerk.
25     Any appointment shall be in writing and the written
26 instrument shall be filed with the oath.
