Sec. 10.1.
Farmworkers.
The Department of Labor shall proscribe the
recruitment by
private
employment agencies of farmworkers
unless the private
employment agency files a statement with the Department of Labor setting
forth the terms and conditions, and the existence of any strike or other
concerted stoppage, slowdown, or interruption of
operations by employees of the prospective employer at the site of the
proposed employment, directly relating to
the employment offered to the farmworkers so
recruited.
A copy of the statement in English and the language in which the
farmworker is fluent shall be given to each farmworker prior to
recruitment by the private employment agencies so recruiting.
The statement shall be made on a form provided to private
employment agencies by the Job Service on
request.
As used in this Section and Section 10.2, "farmworker" means any
person who moves seasonally from one place to another, within or
without the State, for the purpose of obtaining employment relating
to the planting, raising, or harvesting of any agricultural or
horticultural commodities, or the handling, packing, or processing
of those commodities on the farm where produced or at the place of
first processing after leaving that farm.
