Sec. 5.
(a) If, as the result of an investigation, the Department of
Public Health determines that a public health hazard exists at a site due
to mosquitoes or other vectors, it may order such remedial measures as it
deems necessary.
(b) The Department of Public Health may arrange for the cleanup of a
site determined to be a public health hazard, or for the application of
pesticides at such a site, if the person responsible for the site refuses to
take timely appropriate action. The Department shall fine the person
responsible for the site twice the amount of the cost of the
Department's remedial measures.
(c) If, as the result of an investigation, the Department of Public Health
determines that the public interest, safety, or welfare imperatively
requires emergency action to respond to an immediate public health hazard
at a site due to mosquitoes or other vectors, the Director
may issue an emergency order incorporating a finding to that effect; such
order may require closure or isolation of the site, pending a hearing or
other action which shall be promptly instituted and determined.
