Acts soon after they become law. For information concerning the relationship between statutes and Public Acts, refer to the
Guide.
Because the statute database is maintained primarily for legislative drafting purposes,
statutory changes are sometimes included in the statute database before they take effect.
If the source note at the end of a Section of the statutes includes a Public Act that has
not yet taken effect, the version of the law that is currently in effect may have already
been removed from the database and you should refer to that Public Act to see the changes
made to the current law.

Sec. 35. Qualifications for licensure.
(a) An entity
is qualified to
receive a license as a home medical equipment and services
provider if the entity meets each of the following requirements:
(1) complies with all applicable federal and State |
| licensure and regulatory requirements;
|
|
(2) maintains a physical facility and medical
|
| equipment inventory. There shall only be one license permitted at each address;
|
|
(3) establishes proof of commercial general liability
|
| insurance, including but not limited to coverage for products liability and professional liability;
|
|
(4) establishes and provides records of annual
|
| continuing education for personnel engaged in the delivery, maintenance, repair, cleaning, inventory control, and financial management of home medical equipment and services;
|
|
(5) maintains records on all patients to whom it
|
| provides home medical equipment and services;
|
|
(6) establishes equipment management and personnel
|
|
(7) makes life-sustaining home medical equipment and
|
| services available 24 hours per day and 7 days per week;
|
|
(8) complies with any additional qualifications for
|
| licensure as determined by rule of the Department.
|
|
(b) The Department may request a personal interview of an applicant
before the Board to further evaluate the entity's
qualifications for licensure.
