Updating the database of the Illinois Compiled Statutes (ILCS) is an ongoing process.
Recent laws may not yet be included in the ILCS database, but they are found on this site as
Public
Acts soon after they become law. For information concerning the relationship between statutes and Public Acts, refer to the
Guide.
Because the statute database is maintained primarily for legislative drafting purposes,
statutory changes are sometimes included in the statute database before they take effect.
If the source note at the end of a Section of the statutes includes a Public Act that has
not yet taken effect, the version of the law that is currently in effect may have already
been removed from the database and you should refer to that Public Act to see the changes
made to the current law.

Sec. 2-8.
Services provided by the Department under the
Program shall be denied:
(a) if the adult with a mental disability no longer |
| meets the eligibility criteria,
|
|
(b) if the adult with a mental disability submits
|
| false information in an application or reapplication for participation in the Program, or
|
|
(c) if the adult with a mental disability fails to
|
| request or access any services after 120 days. Prior to making the decision, if the adult with mental disabilities has failed to request or access any services within 90 days, the Department shall give written notice to the person who signed the application that participation in the Program will be denied if services are not requested or accessed within 30 days.

Whenever services provided by the Department under the Program are denied
for the reasons in paragraphs (a), (b), or (c) of this Section, the Department shall give
written notice of the decision and the reasons for denial of services to
the person who signed the application. Such notice shall contain
information on requesting an appeal under Section 2-13.
