Updating the database of the Illinois Compiled Statutes (ILCS) is an ongoing process.
Recent laws may not yet be included in the ILCS database, but they are found on this site as
Public
Acts soon after they become law. For information concerning the relationship between statutes and Public Acts, refer to the
Guide.
Because the statute database is maintained primarily for legislative drafting purposes,
statutory changes are sometimes included in the statute database before they take effect.
If the source note at the end of a Section of the statutes includes a Public Act that has
not yet taken effect, the version of the law that is currently in effect may have already
been removed from the database and you should refer to that Public Act to see the changes
made to the current law.

Sec. 13.
Procedures for Consideration of Petition for Withdrawal.
1. Within
5 days after the receipt of a petition for withdrawal of land from an agricultural
area, the county board shall provide notice of such petition by publishing
a notice in a newspaper having general circulation in the immediate area
of the affected land or, if no such newspaper has a general circulation
within such area, then in a newspaper having general circulation within
the county, and by posting such notice in 5 conspicuous places within the
immediate area of the affected land. Such notice shall contain the following
information:
(a) a statement that a petition for withdrawal of land from an agricultural
area has been filed with the county board pursuant to this Act;
(b) a statement that the petition will be on file open to public inspection
at the county clerk's office;
(c) a brief, narrative description of the location of the affected land;
(d) a statement of the proposed non-agricultural use of the land;
(e) a statement that the petition will be referred to the county committee
and to the regional and county planning commissions, if any, for review and comment;
(f) a statement that a public hearing will be held within 60 days on the
petition and on the recommendations of the county committee and of the regional
and county planning commissions, if any, at a time and place to be announced.
2. Within 5 days after the receipt of a petition for withdrawal of land
from an agricultural area, the county board shall refer the petition to
the county committee, which shall, within 30 days of its receipt of the
petition, report to the county board its recommendations.
3. Within 5 days after the receipt of a petition for withdrawal of land
from an agricultural area, the county board shall refer the petition
to the regional and county planning commissions, if any, which shall, within
30 days of their receipt of the petition, report to the county board their
recommendations concerning the potential effect of the withdrawal of land from
an agricultural area upon the development patterns and needs of the county
and upon the county's planning objectives.
