Illinois Compiled Statutes (ILCS)
Updating the database of the Illinois Compiled Statutes (ILCS) is an ongoing process. Recent laws may not yet be included in the ILCS database, but they are found on this site as Public Acts soon after they become law. For information concerning the relationship between statutes and Public Acts, refer to the Guide.
Because the statute database is maintained primarily for legislative drafting purposes, statutory changes are sometimes included in the statute database before they take effect. If the source note at the end of a Section of the statutes includes a Public Act that has not yet taken effect, the version of the law that is currently in effect may have already been removed from the database and you should refer to that Public Act to see the changes made to the current law.
(305 ILCS 5/5-5e.1) Sec. 5-5e.1. Safety-Net Hospitals. (a) A Safety-Net Hospital is an Illinois hospital that: (1) is licensed by the Department of Public Health as | ||

(2) is a disproportionate share hospital, as | ||

(3) meets one of the following: (A) has a MIUR of at least 40% and a charity | ||
| ||
(B) has a MIUR of at least 50%. (b) Definitions. As used in this Section: (1) "Charity percent" means the ratio of (i) the | ||
| ||
(2) "MIUR" means Medicaid Inpatient Utilization Rate | ||
| ||
(3) "OBRA form" means form HFS-3834, OBRA '93 data | ||
| ||
(4) "Rate year" means the 12-month period beginning | ||
| ||
(c) Beginning July 1, 2012 and ending on December 31, 2026, a hospital that would have qualified for the rate year beginning October 1, 2011 or October 1, 2012 shall be a Safety-Net Hospital. (c-5) Beginning July 1, 2020 and ending on December 31, 2026, a hospital that would have qualified for the rate year beginning October 1, 2020 and was designated a federal rural referral center under 42 CFR 412.96 as of October 1, 2020 shall be a Safety-Net Hospital. (d) No later than August 15 preceding the rate year, each hospital shall submit the OBRA form to the Department. Prior to October 1, the Department shall notify each hospital whether it has qualified as a Safety-Net Hospital. (e) The Department may promulgate rules in order to implement this Section.
(f) Nothing in this Section shall be construed as limiting the ability of the Department to include the Safety-Net Hospitals in the hospital rate reform mandated by Section 14-11 of this Code and implemented under Section 14-12 of this Code and by administrative rulemaking.
