90_HB0077 10 ILCS 5/9-25.5 new Amends the Election Code. Prohibits a regulated entity from making a contribution to a public official or a candidate for public office. Defines "regulated entity". Provides that a violation is a Class A misdemeanor punishable by a fine not to exceed $5000. LRB9000510MWpc LRB9000510MWpc 1 AN ACT to amend the Election Code by adding Section 2 9-25.5. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Election Code is amended by adding 6 Section 9-25.5 as follows: 7 (10 ILCS 5/9-25.5 new) 8 Sec. 9-25.5. Contributions by regulated entities. 9 (a) A regulated entity, or person or agent acting on 10 behalf of a regulated entity, shall not make, directly or 11 indirectly, any contribution to any person who is a public 12 official or a candidate or nominee for public office. 13 (b) For purposes of this Section: 14 "Contribution" means the same as in Section 9-1.4 of this 15 Act. 16 "Regulated entity" means: 17 (1) a public utility company as defined by the 18 Public Utilities Act that engages in the production, 19 storage, transmission, sale, delivery, or furnishing of 20 heat, cold, power, electricity, water, or light (this 21 subsection does not apply to motor carriers whose rates 22 are not regulated by the Illinois Commerce Commission); 23 (2) a telecommunications carrier as defined by the 24 Public Utilities Act; 25 (3) a cable television franchise or cable operator 26 as defined under 602 (9) of the Cable Communications 27 Policy Act of 1984, P.L. 98-549; 28 (4) a gambling operation that is subject to 29 provisions of the Riverboat Gambling Act; and 30 (5) entities engaged in horse racing as defined by 31 the Illinois Horse Racing Act of 1975. -2- LRB9000510MWpc 1 (c) Any regulated entity found in violation of this 2 Section is guilty of a Class A misdemeanor and shall be 3 punished by a fine not to exceed $5,000.
