      20 ILCS 505/7.5 new
          Amends the Children and Family  Services  Act.   Provides
      that  Godparents  of a foster child may be granted visitation
      by the Department of Children  and  Family  Services  or  the
      Juvenile  Court  if  the  persons verify their appointment as
      Godparents, pass a  review  of  their  backgrounds,  and  the
      Department or the Juvenile Court determines the visitation is
      in the best interests of the child.  Effective immediately.

 1        AN  ACT  to amend the Children and Family Services Act by
 2    adding Section 7.5.
 3        Be it enacted by the People of  the  State  of  Illinois,
 4    represented in the General Assembly:
 5        Section  5.   The  Children  and  Family  Services Act is
 6    amended by adding Section 7.5 as follows:
 7        (20 ILCS 505/7.5 new)
 8        Sec. 7.5.  Godparents' visitation.  If a child is  placed
 9    in  foster  care,  then  the  persons  who  are  the  child's
10    Godparents  may be granted visitation rights if they meet the
11    following requirements:
12        (1)  the child's natural or  adoptive  parents  appointed
13    the persons as the child's Godparents, and the appointment is
14    verified  in  a manner accepted by the Department of Children
15    and Family Services or the Juvenile Court;
16        (2)  the persons agree to and subsequently participate in
17    and are qualified in a  complete  review  including  but  not
18    limited   to   background   information   and   psychological
19    examination by the Department of Children and Family Services
20    as provided in the Child Care Act of 1969; and
21        (3)  the  Department  of  Children and Family Services or
22    the Juvenile Court determines that the Godparents' visitation
23    is in the best interests of the child.
24        For the purposes of this Section, a Godparent is a person
25    whose relationship with the  child  was  established  by  the
26    traditional  custom  and  practice  of  the  religion  of the
27    parents or child.
28        Section 99.  Effective date.  This Act takes effect  upon
29    becoming law.
