LRB9000763DPcc HB0094 Engrossed LRB9000763DPcc 1 AN ACT to amend the Illinois Solid Waste Management Act 2 by adding Section 9. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Illinois Solid Waste Management Act is 6 amended by adding Section 9 as follows: 7 (415 ILCS 20/9 new) 8 Sec. 9. Market Development Pilot Program. 9 (a) The General Assembly finds and declares that: 10 (1) Since 1990, Illinois has taken steps to create 11 a market for secondary materials manufacturing 12 enterprises with the assistance of the Department of 13 Commerce and Community Affairs. 14 (2) The benefits of this market development have 15 included a 3-fold return on grant awards and loan 16 investments and a cleaner environment as a result of 17 increased recycling and increased job opportunities where 18 new locally-owned businesses have been created. 19 (3) Efforts to further develop this market are 20 needed to encourage increased use of recycled 21 commodities, develop strategies for transportation and 22 other market conditions, and aid with business and job 23 development in economically-depressed areas of our State. 24 (b) On or before December 31, 1998, the Department shall 25 create a 2-year market development pilot program to expand 26 the market of secondary materials manufacturing enterprises 27 that reuse or remanufacture material that is collected under 28 municipal and business recycling programs. The Department 29 shall: 30 (1) develop a 2-year strategic plan for market 31 development that shall assess existing market conditions HB0094 Engrossed -2- LRB9000763DPcc 1 and projected market conditions, design methods to 2 promote efficient collection and use of recycled waste by 3 municipalities and businesses, suggest public and private 4 sources of investment capital or funds to develop 5 enterprises that reuse or remanufacture secondary 6 materials, and propose recommendations for legislation, 7 appropriations, or other public policies to aid in market 8 development in consultation with existing enterprises 9 that reuse or remanufacture secondary materials, 10 municipalities and businesses that participate in 11 recycling programs, environmental research organizations, 12 other states, and the public; and 13 (2) create a 2-year pilot financial assistance 14 program especially designed to develop secondary 15 materials manufacturing enterprises in 4 enterprise and 16 empowerment zones, located throughout Illinois, that 17 reuse or remanufacture material that is collected in 18 municipal and business recycling programs. 19 (A) The Department shall provide financial 20 assistance to the most viable proposals in the form 21 of low-interest loans or training grants. The size 22 and terms of a loan or grant shall be determined by 23 the Department. 24 (B) In determining the most viable proposals, 25 the Department may consider, among other things, the 26 nature of the business, capital and training needs, 27 program budget constraints, the type and amount of 28 materials that will be diverted from waste disposal, 29 and the impact on job creation in empowerment or 30 enterprise zones. 31 (3) The Department shall hold at least 2 32 informational meetings in the State to publicize the 33 existence of this market development program and the 34 existence of the financial assistance program. The HB0094 Engrossed -3- LRB9000763DPcc 1 Department shall provide technical assistance to 2 potential pilot program participants seeking assistance. 3 (4) The Department shall submit a report to the 4 General Assembly describing the results of the market 5 development program, including its 2-year strategic plan 6 and the results of its pilot program by March 1, 1999. 7 Section 99. Effective date. This Act takes effect upon 8 becoming law.
