Prohibits the Department of Transportation from spending any funds from the general revenue fund or road fund toward the development of an airport in Will County until the Department of Natural Resources and the Environmental Protection Agency have conducted certain studies. Requires these studies to be reported to the General Assembly. Effective immediately. LRB9002280NTsb LRB9002280NTsb 1 AN ACT concerning airports, amending named Acts. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Civil Administrative Code of Illinois is 5 amended by changing Section 63a and adding Section 63b2.9 as 6 follows: 7 (20 ILCS 805/63a) (from Ch. 127, par. 63a) 8 Sec. 63a. The Department of Natural Resources has the 9 powers enumerated in Sections 63a1 through 63b2.963b2.8. 10 (Source: P.A. 88-657, eff. 1-1-95; 89-445, eff. 2-7-96.) 11 (20 ILCS 805/63b2.9 new) 12 Sec. 63b2.9. Will County airport studies. To conduct 13 studies relating to the potential impact a major airport in 14 Will County would have on the area's wetlands, endangered 15 species, and underground watertables and to report the 16 findings from these studies to the General Assembly. 17 Section 10. The Civil Administrative Code of Illinois is 18 amended by changing Section 49.25j as follows: 19 (20 ILCS 2705/49.25j) (from Ch. 127, par. 49.25j) 20 Sec. 49.25j. The Department may make grants to 21 municipalities and airport authorities for the renovation, 22 construction and development of airport facilities. Such 23 grants may be made from funds appropriated for such purpose 24 from the Build Illinois Bond Fund or the Build Illinois 25 Purposes Fund, created by the 84th General Assembly. 26 The Department is prohibited from spending any funds from 27 the general revenue fund or road fund toward the development 28 of an airport in Will County until the Department of Natural -2- LRB9002280NTsb 1 Resources has conducted studies relating to the potential 2 impact a major airport in Will County would have on the 3 area's wetlands, endangered species, and underground 4 watertables, and the Environmental Protection Agency has 5 studied the impact of potential hazardous and toxic waste and 6 removal of refuse from the area. The Department shall report 7 the findings from these studies to the General Assembly. 8 (Source: P.A. 84-109.) 9 Section 15. The Environmental Protection Act is amended 10 by adding Section 4.2 as follows: 11 (415 ILCS 5/4.2 new) 12 Sec. 4.2. Will County airport studies. The Agency shall 13 conduct studies relating to the impact of potential hazardous 14 and toxic waste that may result from the development of a 15 major airport in Will County and removal of refuse relating 16 to airport development from the area. The Agency shall 17 report the findings from these studies to the General 18 Assembly. 19 Section 99. This Act takes effect upon becoming law.
