 1        AN  ACT  to  amend  the Illinois Highway Code by changing
 2    Sections 3-104.1 and 3-108.
 3        Be it enacted by the People of  the  State  of  Illinois,
 4    represented in the General Assembly:
 5        Section  5.   The  Illinois  Highway  Code  is amended by
 6    changing Sections 3-104.1 and 3-108 as follows:
 7        (605 ILCS 5/3-104.1) (from Ch. 121, par. 3-104.1)
 8        Sec. 3-104.1. The  Department  in  cooperation  with  the
 9    municipal  corporate  authorities,  township  authorities, or
10    county authorities is  authorized  to  select  and  designate
11    separate  networks  of  municipal  streets to be known as the
12    federal aid  urban system of streets and  highways  in  urban
13    areas.   The  highways  included  in  such  networks shall be
14    selected and designated in accordance with the provisions  of
15    the Federal Aid Road Act.
16        Any  street or highway included in the federal aid  urban
17    system may be constructed  jointly  at  the  expense  of  the
18    federal  government  and the State of Illinois, or jointly at
19    the expense of the  federal  government,  a  municipality  or
20    municipalities,  a  township  or  townships,  or  a county or
21    counties,  or  jointly  at  the  expense   of   the   federal
22    government,   the   State  of  Illinois,  a  municipality  or
23    municipalities, a township  or  townships,  or  a  county  or
24    counties,  in  accordance  with the provisions of the Federal
25    Aid Road Act.
26        The  authority  having  jurisdiction  over  a  street  or
27    highway prior to its improvement  as  a   federal  aid  urban
28    project  shall  be  responsible  for  maintenance, at its own
29    expense.  If at any time the Department finds that  a  street
30    or  highway  improved  as  a federal aid project is not being
31    properly maintained  by  such  municipality,  township,    or

 1    county,  the Department shall call such fact to the attention
 2    of the corporate authorities or county  authorities,  and  if
 3    within  90  days  after  receipt of such notice the street or
 4    highway has not been put in a condition of proper maintenance
 5    satisfactory  to  the  Department  and  the  Federal  Highway
 6    Administration, then the Department shall immediately proceed
 7    to have such street or highway placed in proper condition  of
 8    maintenance   and   charge  the  costs  thereof  against  the
 9    municipality's  allotment,  township's  allotment,   or   the
10    county's allotment of motor fuel tax funds.

13        Sec.  3-108.  Any  highway  constructed  as a federal aid
14    highway under the provisions of  the  Federal  Aid  Road  Act
15    shall be a part of the State highway system unless, under the
16    provisions  of Section 3-104 or 3-104.1 or similar provisions
17    of this Code, there is an agreement or provision made for its
18    maintenance by the  county,  township,  or  municipality,  in
19    which  case  it shall be a part of the county highway system,
20    township road system, or municipal street system.
