New Act
Creates the Free Tobacco Sample Prohibition Act.
Prohibits a person engaged in a business enterprise
concerning the manufacture, production, sale, or distribution
of tobacco products from directly or indirectly distributing
or causing to be distributed tobacco products without charge
or monetary compensation. Penalty is $100 for a first
offense and $250 for a second or subsequent offense.

1 AN ACT to prohibit the distribution of tobacco product
2 samples.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 1. Short title. This Act may be cited as the
6 Free Tobacco Sample Prohibition Act.
7 Section 5. Definition. As used in this Act, "tobacco
8 product" means any cigar, cigarette, smokeless tobacco, or
9 tobacco in any of its forms.
10 Section 10. Free distribution of tobacco product samples
11 prohibited. No person engaged in any business enterprise
12 concerning the manufacture, production, sale, or distribution
13 of a tobacco product shall directly or indirectly distribute
14 or cause to be distributed any tobacco product without charge
15 or monetary compensation.
16 Section 15. Penalty. Any person who violates any
17 provision of this Act is guilty of a petty offense and for
18 the first offense shall be fined $100 and for a second or
19 subsequent offense shall be fined $250.
