90_HB0395ham001 LRB9001370RCcwam 1 AMENDMENT TO HOUSE BILL 395 2 AMENDMENT NO. . Amend House Bill 395 by replacing 3 everything after the enacting clause with the following: 4 "Section 5. The Criminal Code of 1961 is amended by 5 adding Section 24-3.5 as follows: 6 (720 ILCS 5/24-3.5 new) 7 Sec. 24-3.5. Negligent storage of a handgun. 8 (a) This Section may be cited as the Safe Storage Law. 9 (b) In this Section: 10 (1) "Child" means a person under 18 years of age, 11 or a person under 21 years of age who has been convicted 12 of or adjudicated delinquent for a violation of the 13 Firearm Owners Identification Card Act, Article 24 of 14 this Code, or any similar law of another state or of 15 federal law relating to firearms or other dangerous 16 weapons. 17 (2) "Handgun" has the meaning ascribed to it in 18 subsection (h) of Section 24-3 of this Code. 19 (c) A person commits the offense of negligent storage of 20 a handgun when he or she: 21 (1) is a parent or guardian of a child and permits 22 the child to be present on premises under the parent or -2- LRB9001370RCcwam 1 guardian's control; and 2 (2) leaves the child on the premises without 3 supervision of a person at least 21 years of age; and 4 (3) negligently leaves a handgun on the premises 5 that is not locked in a lock box, secured with a cable 6 lock, or rendered inoperable. 7 (d) Sentence. Negligent storage of a handgun is a petty 8 offense for which the offender may be fined in an amount not 9 to exceed $500. 10 (e) Fines collected under this Section shall be 11 deposited in the Violence Prevention Fund.".
