1 AN ACT to amend the State Finance Act by changing Section
2 5d.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The State Finance Act is amended by changing
6 Section 5d as follows:
7 (30 ILCS 105/5d) (from Ch. 127, par. 141d)
8 Sec. 5d. Except as provided by Section 5e of this Act,
9 the State Construction Account Fund shall be used exclusively
10 for the construction, reconstruction and maintenance of the
11 State maintained highway system. Except as provided by
12 Section 5e of this Act, none of the money deposited in the
13 State Construction Account Fund shall be used to pay the cost
14 of administering the Motor Fuel Tax Law as now or hereafter
15 amended, nor be appropriated for use by the Department of
16 Transportation to pay the cost of its operations or
17 administration, nor be used in any manner for the payment of
18 regular or contractual employees of the State, nor be
19 transferred or allocated by the Comptroller and Treasurer or
20 be otherwise used, except for the sole purpose of
21 construction, reconstruction and maintenance of the State
22 maintained highway system as the Illinois General Assembly
23 shall provide by appropriation from this fund. Beginning with
24 the month immediately following the effective date of this
25 amendatory Act of 1985, investment income which is
26 attributable to the investment of moneys of the State
27 Construction Account Fund shall be retained in that fund for
28 the uses specified in this Section. Federal reimbursements
29 for prior expenditures from the State Construction Account
30 Fund shall be deposited back into the State Construction
31 Account Fund and not into any other State fund.
