          Amends the Child Passenger Protection Act  to  require  a
      parent,  legal  guardian,  or  other person to secure a child
      under the age of 6 in the back  seat  of  a  vehicle  if  the
      vehicle has a passenger side airbag.

 1        AN  ACT  to  amend  the Child Passenger Protection Act by
 2    changing Sections 4, 4a, and 6.
 3        Be it enacted by the People of  the  State  of  Illinois,
 4    represented in the General Assembly:
 5        Section 5.  The Child Passenger Protection Act is amended
 6    by changing Sections 4, 4a, and 6 as follows:
 7        (625 ILCS 25/4) (from Ch. 95 1/2, par. 1104)
 8        Sec.  4.  When any person is transporting a child in this
 9    State under the age of 4  years  in  a  non-commercial  motor
10    vehicle  of the first division, a motor vehicle of the second
11    division with a gross vehicle weight rating of  9,000  pounds
12    or  less,  or a recreational vehicle on the roadways, streets
13    or highways of this State, such person shall  be  responsible
14    for  providing  for  the protection of such child by properly
15    securing him or her in  a  child  restraint  system.  If  the
16    vehicle is equipped with an air bag on the passenger side and
17    the  vehicle  has  a  back seat, a parent, legal guardian, or
18    other person shall properly  secure  the  child  in  a  child
19    restraint  system  in  the  back  seat.   The parent or legal
20    guardian of a child under the age of 4 years shall provide  a
21    child  restraint  system  to any person who transports his or
22    her child.  Any person who transports the  child  of  another
23    shall  not  be  in  violation  of this Section unless a child
24    restraint system was provided by the parent or legal guardian
25    but not used to transport the child.
26        For purposes of  this  Section  and  Section  4a,  "child
27    restraint  system" means any device which meets the standards
28    of the United States Department of Transportation designed to
29    restrain, seat or position children.

 2        Sec. 4a.  Every person, when transporting a child 4 years
 3    of age or older but under  the  age  of  6,  as  provided  in
 4    Section 4 of this Act, shall be responsible for securing that
 5    child  in  either  a child restraint system or seat belts. If
 6    the vehicle is equipped with an air bag on the passenger side
 7    and the vehicle has a back seat, a parent, legal guardian, or
 8    other person shall properly secure that  child  in  either  a
 9    child restraint system or seat belt in the back seat.
