      305 ILCS 5/12-4.5         from Ch. 23, par. 12-4.5
          Amends  the  Illinois  Public  Aid  Code  in   provisions
      regarding  assistance  to  low  income  persons  in  order to
      maintain independent living arrangements.  Provides that  the
      assistance  go  to low income families or individuals who are
      homeless or at risk of homelessness,  and  adds  housing  and
      rent  subsidies  as types of assistance that may be provided.
      Removes provisions that the assistance be  provided  on  site
      and  for  transitional  housing.   Provides  that priority be
      given for funding  to  housing  developments  funded  by  the
      Illinois  Housing Development Authority, rather than priority
      being given for services to the residents thereof.

 1        AN ACT to amend the Illinois Public Aid Code by  changing
 2    Section 12-4.5.
 3        Be  it  enacted  by  the People of the State of Illinois,
 4    represented in the General Assembly:
 5        Section 5.  The Illinois Public Aid Code  is  amended  by
 6    changing Section 12-4.5 as follows:

 9        Sec.   12-4.5.   Co-operation  with  Federal  Government.
10    Co-operate with the Federal Department of  Health  and  Human
11    Services,  or  with any successor agency thereof, or with any
12    other agency of  the  Federal  Government  providing  federal
13    funds,   commodities,  or  aid,  for  public  aid  and  other
14    purposes, in any reasonable manner not contrary to this Code,
15    as may be necessary  to  qualify  for  federal  aid  for  the
16    several  public  aid and welfare service programs established
17    under this Code, including the costs  of  administration  and
18    personnel  training  incurred  thereunder, and for such other
19    aid, welfare and related programs for which federal  aid  may
20    be available.
21        The  Department  may supervise the administration of food
22    and shelter assistance  under  this  Section  for  which  the
23    Department is authorized to receive funds from federal, State
24    and  private sources.  Under such terms as the Department may
25    establish, such monies may be distributed to units  of  local
26    government   and  non-profit  agencies  for  the  purpose  of
27    provision  of  temporary   shelter   and   food   assistance.
28    Temporary  shelter  means  emergency  and transitional living
29    arrangements,   including   related    ancillary    services.
30    Allowable  costs shall include remodeling costs but shall not
31    include other costs not directly related  to  direct  service

 1    provision.
 2        The   Department   may   provide   housing,   appropriate
 3    supportive   services,  and  rent  subsidies  to  low  income
 4    families and individuals who  are  homeless  or  at  risk  of
 5    homelessness  appropriate  supportive  services  on  site  to
 6    enhance   their   ability   to  maintain  independent  living
 7    arrangements or may  contract  for  the  provision  of  those
 8    services  on  site  with  entities  that  develop  or operate
 9    housing developments,  governmental  units,  community  based
10    organizations, or not for profit organizations.  Those living
11    arrangements  may  include  transitional housing, single-room
12    occupancy  (SRO)  housing  developments,  or  family  housing
13    developments.  Supportive services may  include  any  service
14    authorized  under  the  Public  Aid  Code  including, but not
15    limited to, services  relating  to  substance  abuse,  mental
16    health, transportation, child care, or case management.  When
17    appropriate,  the  Department  shall  work  with  other State
18    agencies  such  as  the  Department  of  Mental  Health   and
19    Developmental  Disabilities  and the Department of Alcoholism
20    and Substance Abuse in order to coordinate  services  and  to
21    maximize  funding  for  the housing, supportive services, and
22    rent subsidies.   The  Department  shall  give  priority  for
23    funding  under  this  paragraph  to  services to residents of
24    housing developments which have been  funded  by  or  have  a
25    commitment  of  funds  from  the Illinois Housing Development
26    Authority.
27        The Department shall promulgate specific rules  governing
28    the  selection  of  Distribution  Network  Agencies under the
29    Federal Surplus Commodity Program including, but not  limited
30    to,  policies  relative  to  the  termination  of  contracts,
31    policies  relative to fraud and abuse, appeals processes, and
32    information relative to application and selection  processes.
33    The  Department shall also promulgate specific rules that set
34    forth the information required to be contained  in  the  cost

 1    reports  to  be submitted by each Distribution Network Agency
 2    to the Department.
 3        The  Department  shall  cooperate  with  units  of  local
 4    government and non-profit agencies  in  the  development  and
 5    implementation   of  plans  to  assure  the  availability  of
 6    temporary shelter for persons  without  a  home  and/or  food
 7    assistance.
 8        The  Department  shall  report  annually to the House and
 9    Senate Appropriations  Committees  of  the  General  Assembly
10    regarding  the  provision  of  monies  for such assistance as
11    provided in this Section, including  the  number  of  persons
12    served, the level and cost of food provided and the level and
13    cost  of  each type of shelter provided and any unmet need as
14    to food and shelter.
15        The Illinois Department shall make such  reports  to  the
16    Federal Department or other Federal agencies in such form and
17    containing  such  information  as  may be required, and shall
18    comply with such provisions as may be necessary to assure the
19    correctness and verification of such  reports  if  funds  are
20    contributed  by  the  Federal Government. In cooperating with
21    any federal agency providing federal funds,  commodities,  or
22    aid  for  public aid and other purposes, the Department, with
23    the consent of the Governor, may make necessary  expenditures
24    from  moneys  appropriated  for  such purposes for any of the
25    subdivisions of public aid,  for  related  purposes,  or  for
26    administration.

11        Section 95.  No acceleration or delay.   Where  this  Act
12    makes changes in a statute that is represented in this Act by
13    text  that  is not yet or no longer in effect (for example, a
14    Section represented by multiple versions), the  use  of  that
15    text  does  not  accelerate or delay the taking effect of (i)
16    the changes made by this Act or (ii) provisions derived  from
17    any other Public Act.
