90_HB0768ham001 LRB9003879EGfgam01 1 AMENDMENT TO HOUSE BILL 768 2 AMENDMENT NO. . Amend House Bill 768 by replacing 3 everything after the enacting clause with the following: 4 "Section 1. Short title. This Act may be cited as the 5 Truss Construction Fire Safety Act. 6 Section 5. Definitions. For the purposes of this Act: 7 "Truss" means a framed structural unit made up of a group 8 of triangles arranged in a single plane in such a manner that 9 if loads are applied at the points of intersection of the 10 truss members, only compressive or tensile (nonbending) 11 forces will result in the members. 12 "Truss construction" means a structure in which the roof 13 or floor is supported by trusses. 14 Section 10. Display requirement. 15 (a) A municipality may by ordinance require that a truss 16 construction emblem be affixed to the front of all or any 17 class of structures within the municipality that have truss 18 construction. 19 (b) A county may by ordinance require that a truss 20 construction emblem be affixed to the front of all or any 21 class of structures within the unincorporated area of the -2- LRB9003879EGfgam01 1 county that have truss construction. 2 (c) Where individual structures with truss construction 3 are part of a planned unit development or subdivision, the 4 municipality or county may require the truss construction 5 emblem to be displayed at each entrance to the development or 6 subdivision rather than on each individual structure. 7 Section 15. Registration requirement; fee. 8 (a) A municipality or county that requires display of a 9 truss construction emblem on all or any class of structures 10 may require the owners of those structures to register them 11 with the fire department or other appropriate agency of the 12 municipality or county. 13 (b) The municipality or county may charge a reasonable 14 registration fee to the owners of structures that are 15 required to be registered under subsection (a). These fees 16 shall be used for reasonable costs related to identifying, 17 maintaining records of, and inspecting structures with truss 18 construction; preparing to respond and responding to fires 19 and other safety-related situations in those structures; and 20 any other costs of implementing, administering, or enforcing 21 an ordinance adopted under this Act. 22 Section 20. Truss construction emblem. 23 (a) The truss construction emblem shall have a bright 24 and reflective color or be made of reflective material. The 25 shape of the emblem shall be an isosceles triangle and the 26 size shall be 12 inches horizontally by 6 inches vertically. 27 The following letters shall be printed on the emblem in a 28 conspicuous size and color: 29 "F" to signify a floor with truss construction; 30 "R" to signify a roof with truss construction; and 31 "F/R" to signify both a floor and roof with truss 32 construction. -3- LRB9003879EGfgam01 1 (b) The emblem shall be permanently affixed to the left 2 of the main entrance door at a height between 4 and 6 feet 3 above the ground and shall be installed and maintained by the 4 building owner. 5 Section 99. Effective date. This Act takes effect upon 6 becoming law.".
